Patta Over Water Body Void, Says Supreme Court; Orders Alternative Site for Flat Buyers Before Demolition

Published: · NyayVidhan

The Supreme Court upheld the cancellation of a 2011 ryotwari patta for 0.72 acres in Survey No. 572, Thirumullaivoyal, recorded since 1911 as a Government poramboke tank: Section 14-A of the Tamil Nadu Estates Abolition Act bars pattas for non-ryoti land, and a residential zoning plan cannot override it. As official approvals misled 20 flat buyers, the State must give them an alternative site before demolishing their flats (paras 19, 21, 24, 26-27).

Date of Decision

Bench
Justices S.V.N. Bhatti and N.V. Anjaria
Relevant Acts & Sections
Tamil Nadu Estates (Abolition and Conversion into Ryotwari) Act, 1948 — Sections 3, 11, 14-A; Tamil Nadu Town and Country Planning Act, 1971
Final Outcome

Appeals dismissed, subject to a direction that the Chief Secretary and the District Collector, Tiruvallur, allot the flat owners' society a commensurate vacant site, preferably within six months, before demolishing the 0.22 acres; the flat owners and the bank may sue the developer, owner or mortgagor (paras 27-29).

Key holdings

  1. In a patta dispute the nature of the land is determined from the earliest revenue and survey and settlement records (para 19).
  2. Designation of an area as a mixed residential zone in a development plan cannot override Section 14-A or the Government's rights in water bodies (para 21).
  3. Notice to the patta holder who claimed the interest suffices; a mortgagee and flat buyers claiming through the holder cannot object for want of a hearing (para 22).
  4. Where official approvals misled bona fide flat buyers, the State must allot them an alternative site before demolishing their flats (para 27).

Brief Facts

Survey No. 572 at Thirumullaivoyal, now in Avadi Taluk, is recorded in the 1911 resettlement register as Government poramboke, Kanakkan Kuttai (para 6). In 2011 the District Revenue Officer, Tiruvallur, granted a private holder a ryotwari patta for 0.72 acres; the holder mortgaged it to Tamil Nadu Mercantile Bank, and a builder put up 20 flats on 0.22 acres with municipal approval (paras 7-9). In 2019 the Commissioner of Land Administration cancelled the patta, holding the land a watercourse poramboke (para 10). The Madras High Court dismissed the bank's writ petition and ordered demolition and restoration of the water body (para 11). A flat buyer and the bank appealed (para 12).

Court's Findings

Ryotwari tenure under the 1948 Act covers only ryoti land, and protecting communal Government poramboke needs no prior adjudication (para 17). As Salem Municipality holds, tank land is not ryoti land, and Section 14-A cancels even pattas granted for private tanks (paras 18-18.1). The nature of land is decided from the earliest revenue and settlement records, and the appellants could not show the land was ever ryoti (para 19). A "Mixed Residential Zone" in the development plan cannot efface Section 14-A (para 21). Notice to the patta holder, who claimed the interest, answered the complaint of no hearing (para 22). The revenue records show the land as a tank from the earliest time, and the DRO went beyond the Act in granting the patta (paras 23-24). But the municipality approved the building plans and revenue records were altered, leading bona fide purchasers to rely on them, so the State and its officers must bear the price (paras 26-27).

Legal Principle

Section 14-A of the Tamil Nadu Estates (Abolition and Conversion into Ryotwari) Act, 1948 bars any ryotwari patta for non-ryoti land such as tanks, and such a patta is void whatever later zoning or revenue entries show. Where State approvals misled bona fide purchasers, the State must mitigate their hardship (paras 21, 24, 26-27).

Precedents Relied Upon

  1. Salem Municipality v. P. Kumar (2019) 13 SCC 307
Relied Upon Discussed at ¶ 18

Tank land is not "ryoti land" under Section 3(16), so no ryot rights accrue; Section 14-A cancels even pattas granted for private tanks or ooranis.

  2. State of T.N. v. His Holiness Srilla Ambalavana Pandara Sannadhi Adheenakaratha (1997) 9 SCC 313
Relied Upon Discussed at ¶ 3

Meaning of ryoti land: land held by a ryot for agriculture on payment of rent to the landholder, other than private land.
