O R D E R
Heard Dr. R. M. Sharma and Mr. K. M. Nataraj, learned ASG, appearing for the State of Uttar Pradesh.
2. IA No. 296269 of 2026 has been taken up. The same has been filed by Dr. R. M. Sharma i.e., the person nominated by the Court to assist with regard to the issue at hand relating to the functioning of educational institutions, including Schools and Colleges/Universities.
3. It has been brought to the notice of the Court that a report in the Indian Express Newspaper dated 01.09.2026 discloses that a fake Medical College was running from a farmhouse, which purportedly represents that it is running various courses including D.Pharma, B.Pharma, B.Sc. Nursing, DMLT, BMLT, BAMS, GNM and ANM. The said institution, from the report and the photograph brought on record, appears to be running from an old dilapidated 2/3 rooms structure, which is in the middle of a field, with no other structure appearing to be around it. The said building is also not maintained at all.
4. Based on the report, the local Police at Etah, in Mahmoodpur Nagaria Village in the District of Etah, appears to have taken action. The Police, on investigating the matter, have taken action against one Satender Kumar, who is said to be running the said institution, and also three other persons. One Bhagwan Das Singh Baghel, an illiterate tea seller, was shown as the Chairman of the institution, and upon being questioned, feigned ignorance about what was happening. However, he admitted that he regularly used to sign the College documents provided by Satender Kumar.
5. Mr. K.M. Nataraj, learned ASG, submits that the local Police have acted promptly in the matter and have proceeded with the investigation to a large extent, and the same shall also be taken to its logical conclusion without any undue delay and trial shall also be fast-tracked. He submits that the State has also taken serious note of it and shall not tolerate any such activity, which is totally against public interest.
6. We are also informed that besides the police probe, the Chief Secretary of Uttar Pradesh has also ordered an independent inquiry into the issue. We find that the same was required and that the steps taken are in the public interest so that the entire fraud on society is exposed, and based on the said inquiry future guidelines can be issued by the UGC and all the regulatory bodies to prevent such incidents.
7. We appreciate the quick response and action taken by the State of Uttar Pradesh in the matter.

Learned counsel for the UGC submits that the moment a copy of the Interlocutory Application was served on its counsel, they have written to the Additional Chief Secretary, Higher Education Department, Government of Uttar Pradesh, to examine the said matter. A copy of the letter has been produced before the Court and is taken on record. A suggestion has come from Mr. K.M. Nataraj, learned ASG, that the UGC, having come to know of such activity happening on the ground, may issue an advisory to all authorities/institutions, and especially to the public at large, not to take admission in or deal with institutions without first verifying the authenticity of such institutions.
9. We find the suggestion to be useful and accordingly, a direction is issued to the UGC and all the regulatory authorities to issue such public advisory to act accordingly.
10. On a query to Dr. R.M. Sharma with regard to the progress made by the Child Safety Monitoring Committee, as had been constituted by the High Court of Delhi, where the matter was pending at the relevant point of time and now stands transferred to this Court, he has filed a sealed cover report. Having gone through it, we refrain from dealing with the same or incorporating the communication; however; we indicate that the Committee, with effect from today Dr. R.M. Sharma is authorised to reconstitute the Committee, and the said Committee may have four other members in addition to the Chairman.
11. Accordingly, the matter be listed on the date earlier appointed i.e., 19.11.2026 at 2.00 p.m.
12. Ms. Archana Dave Pathak, learned ASG, who is appearing for the Union of India, shall communicate the order to all the regulatory bodies, in addition to the same being done by the learned counsel appearing for them in the present case. The Union of India is also directed to monitor that these directions are duly complied with the said Regulatory Authorities.
13. The report submitted by Dr. R.M. Sharma, be resealed and kept on record.
