IN THE SUPREME COURT OF INDIA
CRIMINAL APPELLATE JURISDICTION
CRIMINAL APPEAL NO. ____ OF 2026
@ SLP (CRL.) NO. 14645/2026
VIKRAM SARADHANA & ANR. Appellants
VERSUS
STATE OF RAJASTHAN Respondent
O R D E R
1. Heard.
2. Leave granted.
3. Appellants have been arraigned as accused in FIR No.125/2025 for the offences punishable under Sections 8 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. On 26.04.2025, police recovered 878 Capsules of Dicyclomine HCl, Tramadol HCl and Acetaminophen (Proxyco SPAS) weighing 412.66 grams from co-accused Suresh Payala, Mansingh Gurjar and Somdutt Jat. During the course of investigation, it was revealed that appellants, namely, Vikram Saradhana and Mahesh Saradhana operated a medical store in the name of ‘Shiv Shakti Medical Store’ and the appellants purchased the capsules from co-accused Gaurav Khatri and sold them to other co-accused by receiving payments sometimes in cash and sometimes through PhonePe. In other words, the role attributed to the appellants is that they operated a medical store, through which they purchased commercial quantities of capsules of Dicyclomine HCl, Tramadol HCl and Acetaminophen (Proxyco SPAS) from the supplier and sold the same to the co-accused, who were subsequently apprehended with the contraband. Undisputedly, the co-accused, namely, Suresh Payala, Mansingh Gurjar and Somdutt Jat, who were found in conscious physical possession of the contraband.
4. As to whether appellants had indulged in sale of contraband is an issue which will have to be thrashed out during the course of trial and it is based only on the statement of the co-accused, the appellants have been apprehended. The appellants having no criminal antecedents is yet another factor which would sway in our mind to accept their prayer for grant of bail. Apart from the fact that the investigation has been completed, chargesheet has been filed and trial has commenced and as such their continued incarceration is not warranted. Hence, the appeal is allowed, impugned order is set aside and appellants are ordered to be released on bail on such terms and conditions as the jurisdictional trial court may deem fit to impose.
5. Pending application(s), if any, stands consigned to records.
