O R D E R
1. Leave granted.
2. The appellant challenges the order dated 06.07.2026 passed by the High Court of Judicature for Rajasthan Bench at Jaipur in S.B.Crl. Misc. 2nd Bail Application No.9510/2026 whereby the High Court had rejected the bail application of the appellant.
3. The appellant was arrested on 12.04.2026 in connection with FIR No. 374/2026 dated 12.04.2026 registered at Police Station Shivdaspura, District-Jaipur City (South) for the offence punishable under Sections 8/22 of the Narcotic Drugs & Psychotropic Substances Act, 1985.
4. Heard learned counsel appearing for the respective parties and perused the material placed on record. The recovery which has been effected from the appellant is of intermediate quantity. The charges have also been framed. The co-accused have been granted bail. No witnesses have been examined till date out of a total of fifteen (15) prosecution witnesses. There is no other case registered or pending against the appellant.
5. Keeping in view the above facts, we are of the considered view that the appellant has made out a case for interference with the impugned judgment/order dated 06.07.2026 passed by the High Court of Judicature for Rajasthan Bench at Jaipur. Hence, we grant bail to the appellant on such terms and conditions as may be fixed by the Trial Court.
6. To comply with this order, the appellant shall be produced before the Trial Court forthwith.
7. Learned counsel for the State/Prosecution undertakes to produce all the witnesses on such dates as may be fixed by the Trial Court. The trial is expedited.
8. The appellant shall fully cooperate during the trial, shall not misuse the liberty in any manner, and shall not seek any unnecessary adjournment. If the trial not progress on account of the non-cooperation of the appellant, it shall be open for the prosecution to move an appropriate application for cancellation of bail, should the need so arise.
9. If the appellant(s) possesses a passport, the same shall be surrendered before the Competent Authority/Court until the conclusion of the trial or until directed otherwise.
10. The impugned order dated 06.07.2026 passed by the High Court of Judicature for Rajasthan Bench at Jaipur in S.B.Crl. Misc. 2nd Bail Application No. 9510/2026 shall stand set aside.
11. Accordingly, the appeal is allowed.
12. Pending application(s), if any, shall stand disposed of.
