O R D E R

1. Leave granted.

2. Heard learned counsel for the parties.

3. This appeal arises from an order dated 17.04.2026 passed by the High Court of Judicature for Rajasthan at Jaipur rejecting the application of the appellants seeking suspension of sentence pending consideration of their appeal by the High Court.

4. At the outset, the learned counsel for the appellants has placed before us the order passed on the criminal appeal of Badri (co-accused) who has been granted the benefit of suspension of sentence pending consideration of his appeal by the High Court. Besides, it appears to be a case where there were 15 accused variously armed. The person, who has suffered injury from the axe, is Krishna and the use of axe is attributed to Ramjivan whereas the other accused including the appellants were shown to be armed with sticks.

5. Having regard to the facts of the case as also that co-convict has been granted the benefit of suspension of sentence by this Court, we are of the view that the appellants are also entitled to similar relief.

6. Accordingly, the appeal is allowed. The order of the High Court rejecting the prayer of the appellants to suspend the sentence pending consideration of their appeal is set aside. The sentence awarded by the trial court to the appellants shall remain suspended pending consideration of their appeal by the High Court.

7. The appellants shall be released on bail on such terms and conditions as the trial court may deem fit to impose in the facts and circumstances of the case.

8. Pending application(s), if any, shall stand disposed of.
