The Supreme Court set aside an Allahabad High Court order granting bail to an accused under the UP Gangsters Act, finding that the High Court was not told of his criminal history - nine cases listed in the State's counter affidavit - and was misled that he had none. The bail plea goes back to the High Court for fresh consideration, and the accused must surrender by 30.10.2026 (paras 3-4, 7-12).
The Supreme Court granted bail to Sandip Ghosh, charge-sheeted by the CBI's Anti-Corruption Branch, Kolkata, over alleged financial irregularities in the college where he was Principal and the alleged accommodation of undeserving candidates through manipulated merit scores. In its follow-up on delays in executing civil decrees, the Supreme Court noted that 17 High Courts support District Execution Cells, four oppose them, three are still considering, and the Rajasthan High Court has not responded. It asked the supporting High Courts to set up the cells, directed the Union Law Ministry to file an affidavit on funding, and required executing courts to call for judgment-debtors' asset affidavits (paras 2-8).
Where a builder failed to deliver a flat bought with a home loan disbursed under a tripartite agreement, the Supreme Court held the buyer entitled only to the Rs.1.27 crore he paid himself, with 12% interest, not the Rs.2.19 crore refund ordered by the NCDRC, which included the lender's money. Paying him unrepaid loan money would be unjust enrichment; he gets Rs.15 lakh compensation but no rent on top of interest (paras 28, 31, 37, 41).
The Supreme Court dismissed appeals by Yes Bank, the RBI and the Union of India against the Bombay High Court's 2023 judgment setting aside the Administrator's write-down of Yes Bank's Rs. 3,000 crore and Rs. 5,415 crore AT-1 bonds on 14.03.2020. The final Reconstruction Scheme had dropped the write-down clause, any write-down had to precede the reconstruction, and at the point of non-viability only the RBI could write the bonds down (paras 40, 63, 70, 80).
The Supreme Court upheld the admission into insolvency of the companies owning the JW Marriott Hotel, Bangalore and the Crowne Plaza Hotel, Pune, on Omkara ARC's Section 7 petitions. Default need only be shown on a summary, prima facie standard; an authenticated Information Utility record of default is by itself sufficient and displaceable only by clear, cogent material; and a positive EBITDA does not disprove default (paras 47, 55, 58, 65).
The Supreme Court upheld the Delhi High Court's ruling that a sub-contract clause refusing interest claims on held-up payments, deposits and delayed payments "or otherwise" barred the arbitrator from awarding pre-reference and pendente lite interest under Section 31(7)(a) of the Arbitration and Conciliation Act, 1996. The residuary words are not read down by ejusdem generis; the contractor keeps its substantive claims and post-award interest (paras 14, 16-18).
The Supreme Court dismissed Tamil Nadu's challenge to a Madras High Court judgment striking down G.O.(Ms.) No. 314 of 09.03.2024, which let converts to Islam from Backward Class, Most Backward Class, Denotified and Scheduled Caste communities to be certified as members of seven notified Backward Class Muslim communities. Conversion establishes religious affiliation, not membership of a birth-based community, and backwardness suffered in the Hindu social order does not travel into the new religion (paras 39, 45, 62-63).
The Supreme Court suspended the life sentence of a man convicted of a 1997 sword attack and murder at Chandabali Bazar in Bhadrak, Odisha, and granted him bail pending his appeal. He has served more than twelve years, and, prima facie, contradictions in the evidence, including a witness's failure to identify him, 'act as a mirror' to his contentions (paras 6-11).
The Supreme Court invited the Supreme Court Bar Association, the Supreme Court Advocates on Record Association, the Delhi High Court Bar Association and all District Bar Associations in Delhi to say why the elections of all bar associations should not be held on one date. It also asked the SCBA Election Committee for a status report on reforms to the SCBA Rules (paras 1-2).

No personal data can be taken for the period before the offence, and later data only with privacy safeguards and proportionality. His arrest remains stayed until further orders (paras 11-13).
The Supreme Court held that an order of a Single Judge in civil contempt proceedings that goes into the merits, such as rejecting a compliance order and requiring fresh compliance, can be challenged in a Special Appeal under the Allahabad High Court Rules, because civil contempt is not 'criminal jurisdiction'. It doubted Ram Kishan Fauji v. State of Haryana (2017), which treats writs with a criminal root as criminal jurisdiction barring intra-court appeals, and referred it to a larger Bench (paras 33, 38, 52).
