HON'BLE MR. JUSTICE FARJAND ALI
Order
26/10/2026
1. The appeal has been filed on behalf of the appellant-victim with the prayer that the accused-respondents may be awarded the maximum sentences for the offences for which they were convicted by the learned Trial Court. Indeed, under the new regime of procedural law, the victim has been conferred with the right to prefer an appeal against an order of acquittal, or on the ground of inadequacy of compensation, or in cases of conviction for a lesser offence. However, nowhere in the statutory provisions has a right been conferred upon the victim or the complainant to prefer an appeal for enhancement of the sentence. Such a right is available only to the State authorities. Thus, the appeal is not maintainable to the extent of this prayer. However, with regard to the alternative prayer sought through the instant appeal, namely, that the maximum compensation be awarded, the appeal would be maintainable.
2. The appeal against judgment of conviction has also been moved at the instance of accused bearing S.B. Criminal Appeal No.1338/2026 thus it would be apt to reconsider the material, thus admit.
3. Issue notice.
4. Call for the record.
5. Both the appeals shall remain connected.
