FACTS:

Snehal Anandrao Bhosale, admitted to a B.Sc. Honors (Agricultural) course for academic year 2026-27 under the Scheduled Tribe reserved category, had submitted her tribe claim verification proposal to the Caste Scrutiny Committee on March 30, 2026. Her caste validity certificate remained pending as the September 4, 2026 submission deadline approached.

A Government Circular dated September 4, 2026 extended the certificate-submission deadline by three months for students belonging to Scheduled Castes, Nomadic Tribes, and other reserved categories, but did not extend the same benefit to Scheduled Tribe students. The petitioner approached the Bombay High Court seeking a direction that her admission not be cancelled and that she be granted the same three-month extension.

COURT'S ANALYSIS:

A Division Bench of Justice Sharmila U. Deshmukh and Justice Neeraj P. Dhote examined the Circular and found no rational basis for excluding Scheduled Tribe students from the extension granted to other reserved categories facing the identical difficulty of a pending Scrutiny Committee decision.

The Bench held: "Though, there is no specific mention of Scheduled Tribe in the Circular dated 4th September 2026, there is no reason as to why the time for submitting the caste validity certificate should not be extended identically in respect [of the] ST student. The non-inclusion, if any, in the Circular dated 4th September 2026 is prima facie, discriminatory."

HOLDING:

The Bombay High Court allowed the petition, extending the three-month benefit under the September 4, 2026 Circular to the petitioner, directing the Caste Scrutiny Committee to decide her tribe claim proposal within six weeks, and prohibiting cancellation of her admission pending the next hearing.
