HON'BLE DR. JUSTICE NUPUR BHATI

Order

02/11/2026

1. The present writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking grant of interim bail to the petitioner, who is presently in the judicial custody in connection with the multiple FIRs registered at different places.

2. It is not in dispute that the petitioner is an under-trial prisoner and is in custody in connection with multiple FIRs registered against him for the offences under the provisions of the NDPS Act. The list of pending FIRs/cases in which interim relief is sought has been annexed as Annexure-6 to the writ petition. The details thereof are as follows:

[Table, as printed:]

| S. No. | Master S. No. | FIR No. | Police Station | District | Section | Case Status |

| 1. | 1 | 0034 | Bassi | Chittorgarh | NDPS Act | Pending |

| 2. | 8 | 0089 | Bassi | Chittorgarh | NDPS Act | Pending |

| 3. | 9 | 0046 | Sadaas | Chittorgarh | NDPS Act | Pending |

| 4. | 15 | 0102 | Samdari Barmer | Barmer | NDPS Act | Pending |

| 5. | 18 | 0516 | Neham | Rohtak | NDPS Act | Pending |

| 6. | 19 | 0318 | DING | Sirsa | NDPS Act | Pending |

| 7. | 20 | 0253 | Chittorgarh | Chittorgarh | NDPS Act | Pending |

| 8. | 21 | 0076 | Bassi | Chittorgarh | NDPS Act | Pending |

| 9. | 27 | 0025 | Bassi | Chittorgarh | NDPS Act | Pending |

3. Counsel for the petitioner submits that the present writ petition has been filed seeking the petitioner’s release on interim bail on the ground that the petitioner had undergone surgery after sustaining multiple fractures in both lower limbs, pursuant to which metallic implants, including rods, interlocking wires and plates, were inserted in his legs. Counsel for the petitioner further submits that the said implants are causing severe and continuous pain to the petitioner, necessitating their removal.

4. In compliance with the order dated 16.10.2026, learned Deputy Government Advocate has produced a report dated 01.11.2026 of the Medical Board constituted by the Government. The Board, comprising Dr. Pravin Sukiriya, M.S. (Orthopaedics), and Dr. Santosh Kumar Yadav, M.S. (Orthopaedics), has opined that the implants are causing pain to the petitioner. The Board has further opined that with the petitioner’s consent, he may be admitted to the Government Medical College for removal of the implants.

5. The report dated 01.11.2026, is taken on record.

6. Having heard learned counsel for the petitioner as well as learned Deputy Government Advocate, and having perused the material available on record, including the report of the Medical Board, this Court is of the considered view that a case for grant of limited interim bail on humanitarian and medical grounds is made out. The petitioner requires specialized medical treatment for removal of the implants, and the medical report supports the genuineness of his ailment. Interim bail on medical grounds is a recognized basis for temporary release, particularly where the medical need is established by an independent medical opinion.

7. The relief sought is limited, specific and time-bound. The multiplicity of FIRs registered against the petitioner at different places, coupled with the urgent medical requirement, makes it impracticable to require the petitioner to approach different courts for identical interim relief. In such peculiar circumstances, this Court considers it appropriate to exercise its extraordinary jurisdiction under Article 226 of the Constitution of India and pass a consolidated order applicable to all the FIRs enumerated above.

8. Taking a humanitarian view of the matter and subject to the conditions enumerated hereunder, this Court deems it fit to grant interim bail to the petitioner for a period of ‘20 days’ from the date of his actual release.

9. Accordingly, the instant writ petition for grant of interim bail is allowed and it is ordered that the petitioner-Shri Ram S/o Bheru Lal, arrested in connection with the aforesaid FIRs, shall be released on interim bail for a period of '20 days' from the date of his actual release provided he furnishes a personal bond in the sum of Rs.1,00,000/- alongwith two sound and solvent sureties in the sum of Rs.50,000/- each (out of which, one shall be furnished by a close family member of the accused-petitioner) to the satisfaction of the trial court. The concerned jail authority shall give the date of surrender to the petitioner.

10. It is made clear that the present order shall be applicable qua all the FIRs, the details of which have been set out in para 2 of this order.
