Conversion of Charge From Rule 17B to 17A Does Not Relate Back; Censure Bars Promotion: Madras High Court

Published: · NyayVidhan

A Division Bench of the Madras High Court at Madurai dismissed a court employee's plea for promotion as Bench Clerk Grade I, holding that converting her charge memo from Rule 17B to Rule 17A in February 2026 did not relate back to the original memo of July 2025 (para 7). She was rightly overlooked first because of the pending charge and then because of the currency of a censure (para 7).

Key holdings

  1. Conversion of a charge memo from Rule 17B to Rule 17A does not relate back to the original memo (para 7).
  2. A pending Rule 17B charge on the date the panel is drawn justifies overlooking the employee for promotion (para 7).
  3. The currency of a censure bars promotion under Section 7(f) read with Schedule II of the 2016 Act (paras 3, 7).

Judgment digest by NyayVidhan: a summary of the court's judgment, not its text. The judgment itself is the authoritative version.

Brief Facts

The petitioner, appointed as a Reader in 1997 in the Tamil Nadu Judicial Ministerial Service, became Sheristadar at the Sub Court, Sivagangai, in April 2025 (para 3). On 08.07.2025 she was served a charge memo under Rule 17B for an act allegedly committed in December 2004, and when the promotion panel was drawn on 29.10.2025 she was overlooked and a junior promoted (para 3). On 09.02.2026 the charge was converted to Rule 17A and censure imposed; when three more juniors were promoted on 10.07.2026, she was again overlooked during its currency (para 3).

Court's Findings

With the facts undisputed, and the petition taken up for final disposal by consent, the only question was whether the conversion should relate back to 08.07.2025, since a pending Rule 17A charge does not bar inclusion in the approved list (paras 2, 5). The Bench held that under the Tamil Nadu Government Servants Conditions of Service Act, 2016, read with Schedule II, the petitioner was rightly not considered on 29.10.2025, when a Rule 17B charge memo was pending, and again on 10.07.2026, when the censure of 09.02.2026 was in operation (para 7). It rejected the claim that the memo of 08.07.2025 should be treated as issued under Rule 17A because of the later conversion, holding: "There is no scope of such relation back in service jurisprudence" (para 7).

Legal Principle

A later conversion of a charge memo from Rule 17B to Rule 17A does not relate back to the date of the original memo. A government servant facing a pending Rule 17B charge, and later a current censure, is rightly overlooked for promotion under the Tamil Nadu Government Servants Conditions of Service Act, 2016 (para 7).
