HON'BLE MR. JUSTICE VINIT KUMAR MATHUR
HON'BLE MR. JUSTICE CHANDRA SHEKHAR SHARMA
Order
28/10/2026
1. The matter comes up on an application (IA No.1/2026) filed by the respondent for early disposal of the case on the ground that the Special Leave to Appeal No.1745/2024 -JNVU & Anr. Vs Lalit Gehlot has been dismissed by the Hon’ble Apex Court vide order dated 20.8.2026 while deciding the batch of SLPs headed by SLP No.1258/2024 and therefore, the present appeal may be disposed of in the light of the judgment rendered by this Court in the case of Lalit Gehlot & Ors. Vs. JNVU (SBCWP No.5666/2022), decided on 26.4.2023 and in the case of Jai Narayan Vyas University, Jodhpur & Anr. Vs. Santosh Kumar (DBSAW No.1700/2025), decided on 16.9.2026.
2. Learned counsel for the respondent submits that the Division Bench of this Court on 18.11.2024 has granted the interim order to the appellant-JNVU on the ground that judgment passed in the case of Lalit Gehlot (supra) has been challenged before the Hon'ble Supreme Court and vide order dated 22.1.2024, the order passed by the Division Bench of this Court in the case of Lalit Gehlot (supra) has been stayed by the Hon’ble Supreme Court.
3. The learned counsel further submits that the controversy involved in the present case is no more res-integra as on earlier occasion too, the other appeals filed by the appellant-JNVU have been dismissed by the orders passed by Division Bench of this Court as well as SLPs filed before the Hon'ble Supreme Court.
4. The learned counsel for the respondent submits that recently DBSAW No.1700/2025 filed by the appellant University against one Santosh Kumar has also been dismissed by the Co-ordinate Bench of this Court vide order dated 16.9.2026 holding that the case of the respondent is not distinguishable from the case of JNVU, Jodhpur & Anr. Vs. Mukesh Sharma (Civil Appeal No.2096-2198/2022), decided on 28.3.2022 and the controversy raised in the case of Mukesh Sharma (supra) has attained finality till the Hon’ble Apex Court.
5. Learned counsel further submits that while relying upon the judgment passed by this Court in the case of Santosh Kumar, even the Hon’ble Supreme Court, rejected the SLP filed in the case of Lalit Gehlot (supra) vide order dated 20.8.2026. He, therefore, prays that the present appeals may also be dismissed in the light of the dismissal of the appeal filed in the case of Lalit Gehlot (Supra).
6. Learned counsel for the appellant-JNVU in these circumstances has though vehemently opposed the submissions as well the contents of the application, however she is not in a position to refute the fact that the SLP filed in the case of Lalit Gehlot (supra) has been dismissed by the Hon’ble Supreme Court vide order dated 20.8.2026.
7. Heard the learned counsel for the parties and perused the material available on record.
8. The Co-ordinate Bench of this Court passed the following interim order in the present special appeal vide order dated 18.11.2024: “Heard on prayer for stay. Learned counsel for the appellants would submit that relief has been granted to the respondent-writ petitioners relying upon the order passed by this Court in the case of Lalit Gehlot & Ors. Vs. Jai Narain Vyas University, Jodhpur (S.B. Civil Writ Petition No.5666/2022). The judgment of this Court in the case of Lalit Gehlot (supra) has been challenged in the Hon’ble Supreme Court and vide common order dated 22.01.2024, the order passed in the case of Lalit Gehlot (supra) has been stayed. Learned counsel appearing for the respondents-writ petitioners in all these appeals except S.A.W. No.255/2024 would submit that though the Hon’ble Supreme Court has stayed the order passed in the case of Lalit Gehlot (supra), there were earlier round of litigation and favourable orders have been passed in favour of the employees seeking regularization similarly situated as the respondents in the case of Jai Narain Vyas University, Jodhpur & Anr. Vs. Bhanwar Singh and Jai Narain Vyas University, Jodhpur & Anr. Vs. Mukesh Sharma. Therefore, it is submitted that even though the writ petitions were disposed of on the basis of order passed in the case of Lalit Gehlot (supra), stay granted by the Hon’ble Supreme Court would not affect the merits of the present case. At this stage, what we find is that the sole basis for the learned Single Judge to allow the writ petition in the case of Lalit Gehlot (supra), which order has been stayed by the Hon’ble Supreme Court on 22.01.2024. Therefore, in these circumstances, the impugned orders cannot be allowed to be executed and is therefore, kept in abeyance awaiting further order as may be passed by the Hon’ble Supreme Court in the case of Lalit Gehlot (supra). List all these appeals for further orders after six weeks.”
9. A reading of the interim order shows that the Division Bench of this Court granted the interim order to the appellant-University relying upon the interim order passed by the Hon’ble Supreme Court on 22.01.2024 in the Special Leave Petition filed by the appellant-University in case of Lalit Gehlot & Ors. (Supra). The hearing of the present appeal was not concluded in view of the fact that the SLP in the case of Lalit Gehlot (Supra) is still pending consideration before the Hon’ble Supreme Court. Now, the Hon’ble Supreme Court vide order dated 20.08.2026 has dismissed the Special Leave Petition filed by the appellant-University in case of Lalit Gehlot (Supra), therefore, nothing survives in the present appeal and the same is, therefore, dismissed.
10. All pending applications as well as stay application also stand disposed of accordingly.

Accordingly, the present appeals are dismissed in the same terms as JNVU vs. Ramesh Pandit (Supra). All the pending applications, if any, stand disposed of accordingly.'
