As per the terms and conditions of the advertisement, a candidate must have educational qualification of: I. Senior Secondary or its equivalent; II. 6. The Department of Medical and Health, Government of Rajasthan vide its order/circular dated 25.07.2023 has formulated a scheme for providing bonus marks to those candidates, who are working in the aforesaid schemes.

7. As per the aforesaid order/circular, the eligible candidate who has completed a period of one year would be entitled to receive 10 bonus marks; such candidates who have completed a period of two years would be entitled to get 20 bonus marks; and those candidates who have completed three years in regular recruitment would be entitled to get 30 bonus marks.

8. It is worthy to note here that those candidates, appointed prior to the COVID-19 pandemic and have served during COVID-19 pandemic period from 22.03.2022 to 13.02.2022 currently working or not; and those candidates who were appointed during COVID-19 pandemic from 22.03.2022 to 13.02.2022 irrespective of the fact whether they are currently working or not, would be entitled to get 15 bonus marks if working period of their contractual/urgent temporary appointment is less than two years; 20 bonus marks if working period of their contractual/ urgent temporary appointment is two years or more but less than three years; and 30 bonus marks if working period of their contractual/urgent temporary appointment is three years or more respectively.

9. The instant bunch of writ petitions has been preferred by several petitioners on the basis of the duties performed by them. It is the case of the petitioners that they are having similar experience of the same work, as performed by the Nursing Officers and the competent authority has also issued experience certificate certifying their work in those schemes, but in spite of having the valid experience certificate, the respondents are not considering their experience, as valid experience for the purpose of getting benefit of bonus marks. Hence, under these circumstances, they have approached this Court by way of filing the instant writ petitions seeking appropriate directions.

10. Per contra, learned counsel appearing on behalf of the respondents opposed the arguments, raised by counsel for the petitioners and submitted that mere working in any of the schemes, as mentioned in Rule 19 of the Rules of 1965, does not entitle the petitioners to get the benefit of bonus marks, as the petitioners have not performed the duties and works assigned to the Nursing Officer. Hence, under these circumstances, the petitioners are not entitled to get the bonus marks and the instant writ petitions are liable to be rejected.

11. Heard and considered the submissions made at the Bar and perused the material available on the record.

12. Perusal of the record indicates that in terms of Rule 19 of the Rules of 1965, the candidates who have performed their duties in any of the scheme, are entitled to get bonus marks as per the experience gained by them in respective years i.e. one year, two years or three years and more. Several kinds of documents have been placed on record by different petitioners on the basis of which they are seeking benefit of bonus marks and the respondent State is opposing their prayer on a technical count that they have not performed the duties of the Nursing Officer.

13. It is the case of the State that the job responsibilities of Health Personnel working on the post of Nurse Gr.I and Nurse Gr. II has been prepared by the State Institute of Health and Family Welfare, Government of Rajasthan, which defines the work and responsibilities of Nurse Gr.I and Gr. II. Carry out other orders as given by competent authority from time to time.”

14. It is the case of the petitioners that their case falls within the above job responsibilities, but the respondents are not treating their functions/experience as valid for getting the benefit of bonus marks.

15. The core controversy involved in these writ petitions is “Whether the work and duties performed by the petitioners, under different Government schemes, can be treated as equivalent to the work and duties performed by the Nursing Officers for the purpose of grant bonus marks.”

16. This Court is not an expert to adjudge and examine the grievance of each singular petitioner and arrive at a definite conclusion that whether duties/functions discharged by him/her under any of the schemes fall within the purview of the job and functions of Nursing Officer or not. Certainly, this task is required to be performed by an expert body of the field.

17. This Court is conscious of the settled principle of law that it cannot function as an expert of any subject matter and such function has to be performed by the field / subject matter expert. Whether the duties of a Nursing staff, working under various schemes of the Government, or other contractual schemes are in any manner identical, similar or distinct from the duties of a regular Nursing Officer, is certainly a technical and factual question, requiring evaluation by persons having domain knowledge in the field of nursing and health administration.

18. This Court, while exercising jurisdiction under Article 226 of the Constitution of India, cannot undertake a comparative assessment of job profiles, work charts and duties of different categories of Nursing Staff. Such exercise essentially falls within the domain of the Health Department and subject matter experts.

19. The Hon’ble Supreme Court in the case of The Maharashtra Public Service Commission through its Secretary vs. Sandeep Shriram Warade and Others reported in 2019 (6) SCC 362 has held that the Court should not sit as an expert over the opinion of experts and where specialized knowledge is required, the matter should be left to the experts. It has been held in para 9 and 10 as under: “9. The essential qualifications for appointment to a post are for the employer to decide. The employer may prescribe additional or desirable qualifications, including any grant of preference. It is the employer who is best suited to decide the requirements a candidate must possess according to the needs of the employer and the nature of work. The court cannot lay down the conditions of eligibility, much less can it delve into the issue with regard to desirable qualifications being at par with the essential eligibility by an interpretive rewriting of the advertisement. Questions of equivalence will also fall outside the domain of judicial review. If the language of the advertisement and the rules are clear, the Court cannot sit in judgment over the same. If there is an ambiguity in the advertisement or it is contrary to any rules or law the matter has to go back to the appointing authority after appropriate orders, to proceed in accordance with law. In no case can the Court, in the garb of judicial review, sit in the chair of the appointing authority to decide what is best for the employer and interpret the conditions of the advertisement contrary to the plain language of the same. 10. The fact that an expert committee may have been constituted and which examined the documents before calling the candidates for interview cannot operate as an estoppel against the clear terms of the advertisement to render an ineligible candidate eligible for appointment.”

20. Considering the controversy involved and in order to avoid any injustice to either side, this Court deems it appropriate to direct the State Government to constitute a Committee comprising of field /subject matter experts to form an opinion on the issue involved.

21. Accordingly, it is directed that: 1. the Principal Secretary, Medical & Health Department, Government of Rajasthan shall constitute a Committee within a period of three weeks, comprising of: (i) Principal Secretary, Department of Medical and Health; (ii) Director (non-gazetted), Department of Medical and Health; (iii) Director, State Institute of Health and Family Welfare, Government of Rajasthan; (iv) Joint Director, Medical and Health (Nodal Officer-Recruitment); (v) Principal, Sawai Man Singh Medical College, Jaipur; (vi) Principal, Jawahar Lal Nehru Medical College, Ajmer; (vii) Principal, Jhalawar Medical College, Jhalawar; and (viii) Registrar, Rajasthan Nursing Council, Jaipur. 2. the said Committee shall examine the Job Description, Work Experience Certificates, Appointment Letters, and actual duties performed by the petitioners vis-a-vis the duties prescribed for Nursing Officers, and submit a reasoned report within a period of four weeks thereafter as to whether the work performed by the petitioners can be considered equivalent for grant of bonus marks. 3. The Committee shall afford an opportunity of hearing to the petitioners/receive their representations and shall submit its report within a period of six weeks from the date of receipt of certified copy of this order.

22. The State Government shall thereafter take a final decision on entitlement of bonus marks, based on the report of expert committee, within a period of four weeks thereafter, strictly in accordance with law and relevant recruitment rules.

23. If the case of the petitioners fall within the opinion, so framed by the experts, then the respondents would consider the case of each of the petitioners for appointment on the post of Nursing Officer, if they are found otherwise eligible.

24. In case, the experience certificate of any of the petitioner is not found to be in purview of the opinion so framed, he/she would be at liberty to approach this Court again by way of filing fresh petition.

25. For a period of two months from today or till receipt of the report of the expert Committee, the interim order passed in favour of the petitioners shall remain in currency.

26. The claim of the petitioners for receiving bonus marks shall be subject to the final decision to be taken by the Government as per expert opinion.

27. With the aforesaid observations and directions, all the instant writ petitions stand disposed of. The stay applications and all pending applications, if any, also stand disposed of.
