O R D E R
1. Leave granted.
2. Appellant has moved claim petition seeking compensation of Rs. 23,02,000/- on account of death of one, Om Prakash, who was a labourer aged about 25 years as on the date of the occurrence of the incident i.e. on 20.11.1997.
3. Basing on the evidence adduced by both the parties in the course of inquiry before the Motor Accident Claims Tribunal (for short, ‘the Tribunal’), an award of Rs.5,45,400/- was passed on 11.10.2004 by the Tribunal.
4. As against the said award, both the parties preferred appeal before the High Court in which, the matter was remanded back to the Tribunal for a fresh inquiry and award.
5. After the matter was remanded back to the Tribunal, the Tribunal passed an award on 01.04.2017 directing payment of Rs.6,11,600/- to the claimant(s). It is this award of the Tribunal which was assailed before the High Court wherein, the impugned order has been passed reducing the amount of compensation from Rs.6,11,600/- to Rs.3,36,112/-.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case, we are of the considered view that the High Court ought not to have reduced the compensation allowed in favour of the claimant(s)/ appellant(s).
7. Accordingly, the impugned order passed by the High Court is set aside and the award passed by the Tribunal in favour of the claimant(s) is restored.
8. Accordingly, the appeal is allowed.
9. Pending application(s), if any, shall stand disposed of.
