1. याची/अभियुक्त अचलेश्वर मीणा की ओर से धारा 482 दण्ड प्रक्रिया संहिता के अंतर्गत यह याचिका प्रथम सूचना रिपोर्ट संख्या 05/2022 दिनांक 08.01.2022 पुलिस थाना प्रधान आरक्षी केन्द्र, भ्रष्टाचार निरोधक ब्यूरो, जयपुर, अपराध अंतर्गत धारा 7, 7ए, 8 भ्रष्टाचार निवारण अधिनियम तथा धारा 201, 120-बी आईपीसी के अंतर्गत दर्ज एफआईआर और उससे उत्पन्न समस्त प्रक्रिया मय आरोप पत्र नंबर 64/2022 अंतर्गत धारा 7, 7ए, 8 भ्रष्टाचार निवारण अधिनियम सपठित धारा 201 और 120बी भा.दं.सं. को अपास्त करने हेतु इस याचिका में अंकित तथ्यों के आधार पर प्रस्तुत की है।
2. याची/अभियुक्त के विद्वान अभिभाषक व विद्वान लोक अभियोजक को सुना गया तथा अभिलेख का अवलोकन किया गया।
3. याची/अभियुक्त के विद्वान अभिभाषक का बहस के दौरान यह तर्क रहा है कि याची/अभियुक्त सेवानिवृत्त लोकसेवक है, जो नगर निगम जयपुर में वित्तीय सलाहकार के पद पर पदस्थ था। भ्रष्टाचार निरोधक विभाग को दिनांक 15.09.2021 को एक सूचना इस आशय की प्राप्त हुई कि नगर निगम ग्रेटर जयपुर के अधिकारियों और कर्मचारियों द्वारा नगर निगम के ठेकेदारों से उनके कार्यों के बिलों के भुगतान के एवज में 2 से 3 प्रतिशत धनराशि बतौर कमीशन रिश्वत के रूप में ली जा रही है। उक्त शिकायत के आधार पर याची/अभियुक्त के मोबइल नंबर एवं श्री गोविन्द कुमार अग्रवाल उर्फ गोपी, श्री धनकुमार, श्री अनिल अग्रवाल, श्री अभिषेक जैन उर्फ टीटू, श्री गंगाराम मीणा, श्री यतेन्द्र सांखला के टेलीफोन को अंतावरोध पर लिया गया। सूत्र सूचना एवं याची/अभियुक्त की मानवीय निगरानी से यह ज्ञात हुआ कि दिनांक 07.01.2022 को याची/अभियुक्त तथा दलाल धन कुमार आपस में मिलकर एकत्रिम कर लाई गई रिश्वत की राशि का आदान-प्रदान करने वाले हैं तथा वे दोनों होटल मैरियट के सामने रोड़ पर मिल चुके हैं तथा याची/अभियुक्त अपनी गाड़ी लेकर अपने निवास स्थान में गया है, जिसके हाथ में एक काले रंग की थैली है, जिसमें एकत्रिम की गई रिश्वत की राशि है। अगर उसके मकान की तलाशी ली जाए तो उक्त रिश्वत की राशि याची/अभियुक्त के कब्जे से बरामद हो सकती है। उक्त आधार पर भ्रष्टाचार निरोधक विभाग के अधिकारी व कर्मचारी याची/अभियुक्त के निवास पर पहुंचे और और मकान के मुख्य दरवाजे की डोरबेल बजाकर याची/अभियुक्त के मकान में बिना तलाशी वारंट के, बिना किसी न्यासंगत व उचित आधार के प्रवेश कर गये और उसके द्वारा धन कुमार से प्राप्त कर लाए गए रुपयों के बारे में पूछा, जिससे याची/अभियुक्त द्वारा मना करने पर सक्षम प्राधिकारी के आदेश के बिना अवैध रूप से आतंक मचाते हुए भ्रष्टाचार निरोधक विभाग ने याची/अभियुक्त के मकान की तलाशी प्रारंभ की। तलाशी में याची/अभियुक्त के कब्जे से कोई रिश्वत की राशि बरामद नहीं हुई और धनकुमार द्वारा दिए गए कागज जिनमें विभिन्न ठेकेदारों के नाम के आगे नंबर पॉइन्ट्स में धनराशि लिखी हुई थी, उसको एसीबी ने बिना किसी आधार के जब्त कर लिया।
4. याची/अभियुक्त के विद्वान अभिभाषक का बहस के दौरान यह भी तर्क रहा है कि एसीबी ने याची/अभियुक्त पर यह आरोप लगाया है कि उसने रिश्वत की राशि को खुर्द-बुर्द कर दिया। उक्त आरोप बिना किसी न्यायसंगत व उचित आधार के लगाए गए हैं। एसीबी ने धन कुमार का याची/अभियुक्त के घर पर आना, याची/अभियुक्त के घर की तलाशी में पेंडिग बिल की सूची बरामद होना, संदिग्ध परिस्थितियों में श्री धन कुमार का याची/अभियुक्त के घर जाना और धन कुमार के घर से तलाशी में 27 लाख रुपए मिलने और अंतावरोध में लिए गए मोबाइल पर हुए वार्ता के आधार पर याची/अभियुक्त को बिना किसी न्यायसंगत व उचित आधार के आरोपी बना दिया। याची/अभियुक्त ने न तो रिश्वत की मांग की और न ही उसके द्वारा रिश्वत ली गई और न ही रिश्वत की राशि उससे बरामद हुई, न ही उसके पास ऐसा कोई बिल लंबित था, जिस बिल को पारित करने के एवज में उसके द्वारा बतौर कमीशन किसी प्रकार की कोई राशि ली जाती। आपराधिक कृत्य करने में उसके द्वारा कोई आपराधिक षड्यंत्र भी नहीं रचा गया। कमीशन के तौर पर उसके द्वारा कोई राशि प्राप्त नहीं की गई। फिर भी बिना किसी न्यायसंगत व उचित आधार के विधिक प्रावधानों की पालना किए बिना मााननीय उच्चतम न्यायालय द्वारा अभिनिर्धारित सिद्धांतों के विपरीत जाकर एसीबी ने याची/अभियुक्त के विरुद्ध प्रथम सूचना रिपोर्ट दर्ज कर आरोप पत्र अंतर्गत धारा 7, 7ए, 8 भ्रष्टाचार निवारण अधिनियम (संशोधन 2018) और धारा 201, 120-बी भारतीय दंड संहिता में प्रस्तुत कर दी।
5. इस प्रकरण में एसीबी ने बिना प्रथम सूचना रिपोर्ट दर्ज किए याची/अभियुक्त के मकान में अनाधिकृत रूप से प्रवेश किया तथा तलाशी और जब्ती की कार्यवाही संपादित की। याची/अभियुक्त के विरुद्ध कोई साक्ष्य नहीं होते हुए संवैधानिक और विधिक प्रावधानों के विपरीत जाकर प्रथम सूचना रिपोर्ट दर्ज कराने से पूर्व याची/अभियुक्त को दिनांक 07.01.2022 को गिरफ्तार कर लिया गया। याची/अभियुक्त के घर की तलाशी तथा अनाधिकृत जब्ती, तथा दिनांक 07.01.2022 को गिरफ्तार कर लिया गया, जबकि उसके विरुद्ध प्रथम सूचना रिपोर्ट दिनांक 08.01.2022 को दर्ज हुई, जो उसके विधिक अधिकारों और उसकी स्वतंत्रता के विपरीत है। याची/अभियुक्त की गिरफ्तारी का और निरुद्धीकरण का कोई प्रथम दृष्ट्या मामला नहीं बनता है, उसके विरुद्ध किसी भी आपराधिक कृत्य किए जाने के तथ्य और साक्ष्य पत्रावली पर नहीं हैं। केवल अंतावरोधित वार्ताओं के आधार पर बिना प्रथम दृष्ट्या मामला होते हुए भी याची/अभियुक्त को अभियुक्त बना दिया गया। गिरफ्तारी के कारणों और आधारों को फर्द गिरफ्तारी में उल्लेखित नहीं किया गया है। याची/अभियुक्त द्वारा रिश्वत की राशि खुर्द-बुर्द करने के मिथ्या आरोपों पर बिना किसी साक्ष्य के, की गई उसकी गिरफ्तारी अवैधानिक है।
6. याची/अभियुक्त के विद्वान अभिभाषक का बहस के दौरान यह भी तर्क रहा है कि इस प्रकरण में टेलीफोन वार्ताओं को रिकॉर्ड करने का आदेश दिनांक 14.10.2021 को विशेष सचिव (गृह) ने पारित किया, जो कि सचिव (गृह) के अधीनस्थ हैं व उक्त आदेश विधि में वर्णित प्रावधानों के तहत विशेष सचिव (गृह) निकालने का अधिकारी नहीं है। एसीबी के द्वारा दिनांक 14.10.2021 को लिखे गए पत्र में लोक सुरक्षा को दृष्टिगत रखते हुए वार्तालाप रिकॉर्ड करने की अनुमति मांगी गई थी। उक्त दिनांक को ही बिना किसी कारण व आधार के अवैध रूप से साइक्लोस्टाइल तरीके से रूटीन में विशेष सचिव (गृह) ने विधिक रूप से अधिकृत नहीं होते हुए भी टेलीफोन टैप करने की अनुमति दे दी। टेलीफोन टैप करने की अनुमति में क्या लोक सुरक्षा थी या क्या आपातकालीन परिस्थितियां थीं, जिसके आधार पर टेलीफोन टेप की अनुमति दी जाए इसका कोई उल्लेख उक्त आदेश में नहीं दिया गया है। याची/अभियुक्त के विरुद्ध क्या आपराधिक कृत्य है, जिसके आधार पर उसके टेलीफोन टैप किए जाने आवश्यक हैं, जो लोक सुरक्षा व लोक आपातकाल के लिए आवश्यक है, इसका भी कोई उल्लेख टेलीफोन टेप की जाने की अनुमति में नहीं किया गया तथा 60 दिवस पश्चात दिनांक 13.12.2021 के आदेश के तहत पूर्व में पारित आदेश के आधार पर ही बिना किसी मस्तिष्क का प्रयोग किए फिर 60 दिवस के टेलीफोन टेप की अनुमति दे दी गई, जो कि पूर्व में ही विशेष सचिव (गृह) द्वारा अनुमति दिया जाना विधिवत नहीं था। ऐसी स्थिति में बाद में सचिव (गृह) द्वारा द्वारा 60 दिवस की टेलीफोन टेप की अनुमति दिया जाना विधि अनुकूल नहीं है। इंडियन टेलीग्राफ अधिनियम, 1885 की धारा 5 सपठित इंडियन टेलीग्राफ नियम, 1951 के नियम 419 सपठित धारा 69 सूचना प्रौद्योगिकी अधिनियम, 2000 के अंतर्गत ऐसी अनुमति विधि की दृष्टि में प्रारंभ से शून्य होने के कारण से निरस्त किए जाने योग्य है, जिसके आधार पर याची/अभियुक्त का टेलीफोन टेप कर वार्ताओं की ट्रांसस्क्रिप्ट तैयार की गई है। वे विधिक दृष्टि से कोई महत्व नहीं रखते हैं। लोक आपातकाल, लोकसुरक्षा सहित भारत की संप्रभुता और एकता और अखंड़ता को खतरा कारित करने की आशंका पर ही टेलीफोन टेप करने की अनुमति दी जा सकती है, इस प्रकरण में याची/अभियुक्त द्वारा कोई अपराध कारित किया गया हो या लोकसुरक्षा व लोक आपातकाल की परिस्थितियां विद्यमान हों यह स्पष्ट नहीं होने के कारण से उक्त विधिक प्रावधानों की पालना नहीं होने पर अपनी अधिकार शक्ति का मनमाना दुरुपयोग किए जाने के कारण टेलीफोन टेप की अनुमति दिया जाना अवैधानिक होने के कारण से एसीबी के द्वारा भारतीय टेलीग्राफ अधिनियम 1985 की धारा 25 सपठित धारा 24, 25 और भारतीय प्रौद्योगिकी (इंटरसेप्शन, मॉनिटरिंग और डिक्रप्शन के लिए प्रक्रिया और सुरक्षा उपाय सूचना) नियम) 2009 का अपराध कारित किए जाने के कारण संपूर्ण अंतावरोध टेलीफोन वार्ता मैसेज नियमों के अनुसार शून्य और प्रभावहीन घोषित किए जाने के साथ निरस्त किए जाने योग्य है।
7. याची/अभियुक्त के विद्वान अभिभाषक का यह भी तर्क रहा है कि Justic K.S. Puttuswamy (Retd.) and Anr. Vs. Union of India and Ors (20147) 10 SCC 1 विनिश्चय में याची/अभियुक्त द्वारा प्राईवेट व्यक्तियों से की गई वार्ता, टैपिंग बिना किसी विधिक प्रावधानों और सक्षम अनुमति के किया जाना गोपनीयता के अधिकार का भारतीय संविधान के अनुच्छेद 21 के अंतर्गत उल्लंघन माना गया है। उक्त विधिक प्रावधान के होते हुए एसीबी ने जान-बूझकर स्वैच्छिक रूप से अपनी शक्तियों और पदस्थितियों का दुरुपयोग करते हुए याची/अभियुक्त के मूलभूत अधिकारों का उल्लंघन किया है।
8. इस प्रकरण में याची/अभियुक्त के टेलीफोन कॉल के टैप के साथ उसकी जासूसी भी की गई है और विभिन्न स्थानों पर प्राईवेट जगहों पर भी याची/अभियुक्त की अनुमति और सहमति के बिना, सक्षम प्राधिकारी द्वारा मजिस्ट्रेट की अनुमति के बिना याची/अभियुक्त के फोटोग्राफ लिए गए हैं। एसीबी या पुलिस अधिकारी ऐसे फोटोग्राफ लेने के लिए अधिकारी नहीं हैं न ही कोई विधि उन्हें ऐसे फोटोग्राफ लेने के लिए अधिकृत करती है। बिना प्रथम सूचना रिपोर्ट के याची/अभियुक्त की कोई गिरफ्तारी, घर की तलाशी तथा जब्ती भारतीय संविधान के अनुच्छेद 21 के अंतर्गत याची/अभियुक्त के स्वतंत्रता और मूल अधिकारों का उल्लंघन होने के कारण से माननीय उच्चतम न्यायालय द्वारा पारित विनिश्चय K.S. Puttuswamy (Retd.) and Anr. Vs. Union of India द्वारा दिए गए आदेश के तहत एसीबी के अधिकारी धारा 66डी आईटी एक्ट के अंतर्गत दंडनीय अपराध के दोषी हैं। उन्होंने स्पष्ट रूप से जानबूझकर अवैधानिक, असंवैधानिक कृत्य किया है।
9. याची/अभियुक्त के विद्वान अभिभाषक का बहस के दौरान यह भी तर्क रहा है कि याची/अभियुक्त के घर में तलाशी और जब्ती की कार्यवाही पीएचईडी विभाग के अतिरिक्त प्रशासनिक अधिकारियों की उपस्थित में की गई है, जिन पर एसीबी के अधिकारी अपनी पर्यवेक्षणीय और प्रभाव रखने की क्षमता रखते हैं। तलाशी व जब्ती क्षेत्र के स्थानीय निवासी दो साक्षीगण की उपस्थिति में नहीं की गई है, ऐसी तलाशी जो बिना वारंट के की गई है, धारा 165 सपठित धारा 100 और ऐसी जब्ती धारा 102 सीआरपीसी के अंतर्गत विधि-विरूद्ध है और धारा 165 के अंतर्गत उक्त तथ्य अन्वेषण की श्रेणी में नहीं आते हैं। याची/अभियुक्त के कब्जे से जो लिस्ट बरामद की गई है वह न तो चोरी हुई है न कोई आपराधिक कृत्य की परिस्थितियों से जुड़ी हुई है। ऐसी स्थिति में धारा 103 सीआरपीसी में वर्णित प्रावधानों के तहत उक्त जब्ती नहीं की जा सकती है और उक्त जब्ती की रिपोर्ट सक्षम क्षेत्राधिकार वाले मजिस्ट्रेट को नहीं भेजे जाने के कारण से संपूर्ण तलाशी और जब्ती की प्रक्रिया धारा 165 सपठित धारा 100 और धारा 102 सीआरपीसी में वर्णित प्रावधानों का उल्लंघन होने के कारण से विधि-विरुद्ध है।
10. याची/अभियुक्त के विरुद्ध आरोपित अपराध अधिकतम 7 वर्ष से दंडनीय अपराध है। ऐसी स्थिति में याची की गिरफ्तारी की स्थिति में सीआरपीसी की धारा 41ए के अंतर्गत अरनेश कुमार बनाम बिहार राज्य (2014) 8 एसीसी 273 विनिश्चय में माननीय उच्चतम न्यायालय द्वारा अभिनिर्धारित सिद्धांतों के तहत याची/अभियुक्त को गिरफ्तार करने, उसको निरुद्ध किए जाने से पूर्व नोटिस दिया जाना चाहिए था। उक्त नोटिस नहीं दिया गया। धारा 50(1) सीआरपीसी में वर्णित प्रावधानों के तहत याची/अभियुक्त को उसकी गिरफ्तारी के आधारों से अवगत नहीं कराया गया न ही याची/अभियुक्त को अपने पसंद के अधिवक्ता से सलाह लेने के विधिक अधिकार को बताया गया और तथ्य की पालना नहीं की गई। प्रथम सूचना रिपोर्ट दर्ज कराने से पहले उसकी गिरफ्तारी हुई, उसके पश्चात उसे संबंधित मजिस्ट्रेट के समक्ष प्रस्तुत किया गया। बिना किसी न्यायसंगत व उचित आधार के याची/अभियुक्त को गिरफ्तार कर धारा 41, 41(ए) धारा 50 सीआरपीसी (धारा 35, 47 बीएनएसएस) सपठित धारा 21 और 22 भारतीय संविधान का उल्लंघन होने और 24 घंटे के अंदर मजिस्ट्रेट के समक्ष उपस्थित नहीं करने के कारण अनुच्छेद 22 सपठित धारा 57 सीआरपीसी का उल्लंघन करने के कारण से याची/अभियुक्त की, की गई गिरफ्तारी अवैधानिक, असंवैधानिक होने के कारण उसकी गिरफ्तारी व समस्त कार्यवाही अवैधानिक घोषित किए जाने योग्य है।
11. याची/अभियुक्त के विद्वान अभिभाषक का बहस के दौरान यह भी तर्क रहा है कि याची/अभियुक्त की गिरफ्तारी विधि विरुद्ध है। याची/अभियुक्त के घर की तलाशी जब्ती दिनांक 07.01.2022 को की गई उसके पश्चात उससे एसीबी के कार्यालय में अनुसंधान के लिए ले जाया गया। उसे दिनांक 07.01.2022 से दिनांक 08.01.2022 तक निरुद्ध रखकर अनुसंधान किया गया और दिनांक 08.01.2022 5.00 पी.एम. पर मजिस्ट्रेट के निवास पर प्रस्तुत किया गया और वह पुलिस अभिरक्षा में दिनांक 11.01.2022 तक रहा। याची/अभियुक्त को दिनांक 08.01.2022 को 5.00 पी.एम. पर पुलिस अभिरक्षा में भेजा गया। उसके पश्चात अवैधानिक रूप से 5.15 पीएम पर प्रथम सूचना रिपोर्ट दर्ज कराई गई। याची/अभियुक्त की पुलिस रिमांड कपटपूर्वक बिना विधिक प्रावधानों के आधार पर की गई और उसे अभिरक्षा में रखा गया। पुलिस की समस्त कार्यवाही प्रारंभ से अवैधानिक तथा असंवैधानिक होने के कारण से संपूर्ण प्रक्रिया निरस्त किए जाने योग्य है।
12. भारतीय टेलीग्राफ नियम 1951 के नियम 419ए के तहत टेलीफोन टैप से संबंधित प्रक्रिया 7 दिवस में रिव्यू कमेटी के समक्ष रखा जाना आज्ञापक है। उक्त नियम के अनुसार टेलीफोन टैप तभी हो सकता है जब अन्य किसी युक्तियुक्त तरीके से सूचना प्राप्त नहीं की जा सकती हो। इस प्रकरण में दिनांक 14.10.2021 को टेलीफोन टैप की अनुमति दी गई और उसकी अभिवृद्धि दिनांक 16.10.2021 तक की गई। भारतीय टेलीग्राफ नियम में वर्णित प्रावधान के अंतर्गत टेलीफोन टैप करने से संबंधित प्रक्रिया को 7 दिवस में रिव्यू कमेटी के समक्ष नहीं रखा गया। इसका कोई कारण भी नहीं बताया गया न ही कोई पत्र लिखा गया और न ही कोई लेटर आदेश संबंधित सचिव द्वारा जारी किया गया। प्रक्रिया 120 दिन तक बिना किसी रिव्यू कमेटी की अनुमति के चालू रही। ऐसी स्थिति में आदेश दिनांक 14.10.2021 और दिनांक 06.12.2021 जो गृह विभाग द्वारा जारी किया गया है, वे टेलीग्राफ नियम 1951 के नियम 419ए के तहत प्रारंभ से अवैधानिक होने के कारण से अपास्त किए जाने योग्य है। इस प्रकरण में याची/अभियुक्त के घर की तलाशी और जब्ती की गई है वह अन्वेषण के उद्देश्य से नहीं की गई है। बिना वारंट के उक्त तलाशी और जब्ती अनुसंधान के लिए अधिकृत व्यक्ति द्वारा भी नहीं की गई है। ऐसी स्थिति में बिना वारंट के उक्त तलाशी और जब्ती धारा 165 सपठित धारा 100 सीआरपीसी में वर्णित प्रावधानों के विरुद्ध होने के कारण अवैधानिक है। इस प्रकरण मेंे श्री रामसहाय शर्मा पुलिस अधिकारी द्वारा उक्त प्रथम सूचना रिपोर्ट दर्ज कराई गई तथा वह परिवादी है और उसके द्वारा ही प्रकरण का अनुसंधान किया गया है। परिवादी प्रकरण का अनुसंधानकर्ता नहीं हो सकता है। ऐसी स्थिति में धारा 165 सीआरपीसी में वर्णित प्रावधानों के तहत याची/अभियुक्त के विरुद्ध की गई सूंपर्ण कार्यवाही अवैधानिक है। प्रथम सूचना रिपोर्ट दर्ज किए बिना किसी व्यक्ति की गिरफ्तारी, उसका निरुद्धीकरण, उसके घर की तलाशी, उसके घर पर की गई जब्ती नहीं की जा सकती है। आपराधिक विधिक शास्त्र के अनुसार आपराधिक प्रक्रिया तभी प्रारंभ होगी जब प्रथम सूचना रिपोर्ट दर्ज होगी। बीएनएसएस और सीआरपीसी में ऐसा कोई प्रावधान नहीं है, जो अनुसंधान अधिकारी को प्रथम सूचना रिपोर्ट दर्ज करने से पूर्व अनुसंधान करने, गिरफ्तारी करने, घर की तलाशी करने या जब्ती करने का अधिकार देता हो। इस प्रकरण में याची/अभियुक्त के विरुद्ध जो समस्त कार्यवाही की गई है, वह विधि-विरुद्ध है। अवैधानिक प्रक्रिया का दुरुपयोग करके याची/अभियुक्त को अनुचित रूप से परेशान करने, उसकी व्यक्तिगत स्वतंत्रता/निजता का हनन करने के उद्देश्य से बिना किसी न्यायसंगत व उचित आधारों के उसके मूलभूत अधिकारों का उल्लंघन होने और उसके विरुद्ध आरोपित अपराध उसको साक्ष्य के आधार पर प्रथम दृष्ट्या स्पष्ट नहीं होने, प्रकरण में विधिक प्रावधानों की पालना नहीं किए जाने, पीसी एक्ट की धारा 17ए के तहत अनुसंधान किए जाने से पूर्व याची/अभियुक्त के लोकसेवक होने के नाते उसकी पूर्व अनुमति नहीं लिए जाने के विधिक प्रावधानों के कारण याची/अभियुक्त के विरुद्ध पुलिस थाना एसीबी जयपुर में प्रथम सूचना रिपोर्ट संख्या 5/2022 को अपास्त करते हुए उसके विरुद्ध पारित आरोप पत्र दिनांक 04.03.2022 पर की गई कार्यवाही को निरस्त करते हुए अपास्त किया जाकर याची/अभियुक्त की याचिका अंतर्गत धारा 482 दंड प्रक्रिया संहिता स्वीकार की जावे।

14. अयाचीगण की ओर से विद्वान लोक अभियोजक का बहस के दौरान यह तर्क रहा है कि याची/अभियुक्त की अन्य सहअभियुक्तगण से हुई वार्ता के आधार पर जिसमें रिश्वत के लेन-देन की वार्ता भी थी, उस आधार पर विधिक प्रावधानों के तहत याची/अभियुक्त के टेलीफोन टैप किए गए और उसके कब्जे में सहअभियुक्त धन कुमार द्वारा दी गई रिश्वत की राशि मिलने की संभावना के आधार पर उसके मकान की तलाशी ली गई और सहअभियुक्त धनकुमार द्वारा दिए गए कागज जिनमें विभिन्न ठेकेदारों के नाम के आगे नंबर पॉईन्ट्स में धनराशि लिखी हुई थी, जो संदिग्ध होने के कारण से उसके कब्जे से जब्त की गई। रिश्वत की राशि याची/अभियुक्त ने खुर्द-बुर्द कर दी। अभियुक्तगण की वार्तालाप से यह सामने आया है कि याची/अभियुक्त पेंडिंग बिलों के भुगतान के लिए कमीशन प्राप्त करना चाह रहा था, और उसने धन कुमार से रिश्वत की राशि ली थी। धनकुमार के घर की तलाशी से करीब 27 लाख रुपए प्राप्त हुए हैं। विधि में वर्णित प्रावधानों के तहत सही रूप से याची/अभियुक्त की गिरफ्तारी व निरुद्धिकरण उसके घर की तलाशी और घर में उपलब्ध सामग्री की जब्ती की गई है। उसके कोई विधिक अधिकारों और मूल अधिकारों का उल्लंघन नहीं हुआ है। अन्वेषण के दौरान जुटाई गई साक्ष्य के आधार पर याची/अभियुक्त के विरुद्ध आरोपित अपराध साबित पाए जाने के कारण उसके विरुद्ध आरोपित अपराध में आरोप पत्र प्रस्तुत किया गया है। ऐसी स्थिति में याची/अभियुक्त द्वारा प्रस्तुत याचिका अंतर्गत धारा 482 दंड प्रक्रिया संहिता आधारहीन होने के कारण से अस्वीकार कर खारिज की जाए।
15. मैंने उभय पक्षों की तर्कों पर मनन किया तथा प्रस्तुत विनिश्चयों का ध्यानपूर्वक अवलोकन कर प्रथम सूचना रिपोर्ट, आरोप पत्र व पत्रावली पर उपलब्ध समस्त दस्तावेजों का अवलोकन किया।
16. इस प्रकरण में निम्न विचारणीय बिंदु हैं:- 1. क्या बिना प्रथम सूचना रिपोर्ट के तथा बिना सर्च वारंट के याची/अभियुक्त के विरुद्ध स्ााक्ष्य नहीं होते हुए उसके घर में प्रवेश कर घर की तलाशी लेना और जब्ती की कार्यवाही करना, उसको गिरफ्तार करना उसकी गिरफ्तारी के पश्चात प्रथम सूचना रिपोर्ट दर्ज करना विधि अनुरूप नहीं है? और क्या यह धारा 165 सपठित धारा 100 दण्ड प्रक्रिया संहिता (धारा 185 सपठित धारा 103 बीएनएसएस 2023) में वर्णित प्रावधानों का उल्लंघन है? तथा याची/अभियुक्त की गिरफ्तारी और उसका निरुद्धीकरण दण्ड प्रक्रिया संहिता की धारा 41, 41ए और 5 (धारा 35 और 47 बीएनएसएस) सपठित भारतीय संविधान के अनुच्छेद 21 और 22 के तहत अवैध, असंवैधानिक और प्रारंभ से शून्य है? 2. क्या धारा 5 भारतीय टेलीग्राफ अधिनियम, 1885 सपठित इंडियन टेलीग्राफ रूल्स, 1951 के नियम 419 सपठित भारतीय सूचना प्रौद्योगिकी अधिनियम, 2000 की धारा 69 के तहत याची/अभियुक्त के टेलीफोन टैप और फोटोग्राफों तथा वीडियो की अनुमति विधि अनुरूप सक्षम प्राधिकारी द्वारा दी गई है? और यदि नहीं, तो क्या याची/अभियुक्त के भारतीय संविधान के अनुच्छेद 19 व 21 में प्रदत्त स्वतंत्रता व निजता के अधिकार का उल्लंघन हुआ है? 3. क्या याची/अभियुक्त पुलिस थाना एसीबी, जयपुर में उसके विरुद्ध दर्ज प्रथम सूचना रिपोर्ट संख्या 5/2022, उसके आधार पर प्रस्तुत आरोप पत्र दिनांक 04.03.2022 और उसके फलस्वरूप की गई समस्त कार्यवाही धारा 482 दंड प्रक्रिया संहिता के अंतर्गत अपास्त किए जाने योग्य है?
विचारणीय बिन्दु संख्या-1
क्या बिना प्रथम सूचना रिपोर्ट के तथा बिना सर्च वारंट के याची/अभियुक्त के विरुद्ध स्ााक्ष्य नहीं होते हुए उसके घर में प्रवेश कर घर की तलाशी लेना और जब्ती की कार्यवाही करना, उसको गिरफ्तार करना उसकी गिरफ्तारी के पश्चात प्रथम सूचना रिपोर्ट दर्ज करना विधि अनुरूप नहीं है? और क्या यह धारा 165 सपठित धारा 100 दण्ड प्रक्रिया संहिता (धारा 185 सपठित धारा 103 बीएनएसएस 2023) में वर्णित प्रावधानों का उल्लंघन है?
17. प्रकरण के तथ्यों और पुलिस निरीक्षक भ्रष्टाचार निरोधक विभाग श्री रघुवीर शरण द्वारा की गई कार्यवाही पुलिस दिनांक 07.01.2022 को 10.30 ए.एम. पर लेखबद्ध की गई, उसके अनुसार उक्त पुलिस निरीक्षक को नगर निगम ग्रेटर जयपुर में कार्यरत ठेकेदारों के बिल पास कराने के लिए दलालों के माध्यम से निगम के अधिकारियों द्वारा गुप्त सूचना से ज्ञात हुआ कि याची/अभियुक्त अचलेश्वर मीणा जो नगर निगम जयपुर में तत्कालीन वित्तीय सलाहकार था, वह दलालों द्वारा एकत्रित की गई राशि को लेकर अपने मकान में गया है। इस पर उक्त निरीक्षक ने अन्य पुलिसकर्मियों को लेकर कांस्टेबल श्री देवेन्द्र सिंह तथा कांस्टेबल श्री मनीष सिंह को बुलाकर जिन्होंने यह सूचना दी कि याची/अभियुक्त एक गहरे ग्रे कलर की थैली को लेकर मकान में घुसा है, जिसमें वह धनकुमार से रिश्वत राशि लेकर आया है। इस पर उक्त पुलिस निरीक्षक श्री रघुवीर शरण ने अन्य पुलिसकर्मियों के साथ याची/अभियुक्त के घर में प्रवेश कर तलाशी ली। दौराने तलाशी पुलिस निरीक्षक श्री रघुवीर शरण को गोविन्द्र कुमार अग्रवाल उर्फ गोपी अग्रवाल याची/अभियुक्त के मकान पर मिला जो याची/अभियुक्त से मिलने आया व एक सूची 1 से लगायत 18 पेज जिसमें जुलाई माह 2020 से दिनांक 29.12.2021 तक सिविल कान्ट्रेक्टर्स के निर्माण कार्यों की बकाया राशि 5964.96 लाख रुपए जयपुर नगर निगम ग्रेटर के लगभग 150-200 ठेकेदारों के बकाया है के विषय में चर्चा करने के लिए आना बताया, जो वजह सबूत जब्त किए। भ्रष्टाचार निरोधक विभाग की शाखा दिनांक 07.01.2022 को 8.30 पीएम पर सहअभियुक्त धनकुमार को एसीबी कार्यालय लेकर आए। अयाची को धनकुमार ने आवाज का नमूना देने से इनकार कर दिया। याची/अभियुक्त को दिनांक 07.01.2022 10.30 पी.एम. पर प्रकरण में प्राप्त सूत्र सूचना के आधार पर अपराध धारा 7 भ्रष्टाचार निवारण (संशोधित) अधिनियम, 2018 एवं 201, 120बी भा.दं.सं. का अपराध किया जाना प्रथमदृष्ट्या प्रमाणित पाए जाने पर उसको जरिए फर्द गिरफ्तार करके गिरफ्तारी की सूचना उसके पुत्र अभय मीणा को मोबाइल पर दिया जाना फर्द में अंकित किया गया है। याची/अभियुक्त के घर पर तलाशी में किसी प्रकार की कोई राशि बरामद नहीं हुई रिश्वत की राशी लाते हुए या इस संबंध में कोई संव्यवहार किए जाने के संबंध में कोई सीसीटीवी की रिकॉर्डिंग इस प्रकरण में जब्त नहीं की गई। गोविन्द्र अग्रवाल उर्फ गोपी अग्रवाल जो याची/अभियुक्त के मकान में मिलने के लिए आया था, उससे ठेकेदारों की बकाया राशि की सूची जब्त की गई। याची/अभियुक्त से रिश्वत की राशि बरामद किए जाने के संबंध में यह बताया गया है कि उक्त राशि उसके द्वारा खुर्द-बुर्द कर दी गई। तत्पश्चात इस प्रकरण में पुलिस निरीक्षक श्री रघुवीर शरण विशेष अनुसंधान अधिकारी भ्रष्टाचार निरोधक ब्यूरो जयपुर ने याची/अभियुक्त के विरुद्ध व अन्य अभियुक्तगण के विरुद्ध धारा 7, 7ए एवं 8 पी0सी0 (संशोधन) एक्ट 2018 तथा धारा 201, 120बी भा.दं.सं. में प्रथम सूचना रिपोर्ट संख्या 5/2022 दिनांक 08.01.2022 रोजनामचा आम रपट संख्या 208 समय 5.15 पर दर्ज करने हेतु प्रेषित की गई।
18. इस स्तर पर सर्वप्रथम धारा 165 दण्ड प्रक्रिया संहिता को यहां उद्धरित किया जाना न्यायोचित होगा:- 165. Search by police officer Whenever an officer-in-charge of a police station or a police officer making an investigation has reasonable grounds for believing that anything necessary for the purpose of an investigation into any offence which he is authorised to investigate may be found in any place within the limits of the police station of which he is incharge, or to which he is attached, and that such thing cannot in his opinion be otherwise obtained without undue delay, such officer may, after recording in writing the grounds of his belief and specifying in such writing, so far as possible, the thing for which search is to be made, search, or cause search to be made, for such thing in any place within the limits of such station. 2) A police officer proceeding under sub-section (1), shall, if practicable, conduct the search in person. 3) If he is unable to conduct the search in person, and there is no other person competent to make the search present at the time, he may, after recording in writing his reasons for so doing, require any officer subordinate to him to make the search, and he shall deliver to such subordinate officer an order in writing, specifying the place to be searched, and so far as possible, the thing for which search is to be made; and such subordinate officer may thereupon search for such thing in such place. 4) The provisions of this Code as to search-warrants and the general provisions as to searches contained in section 100 shall, so far as may be, apply to a search made under this section. 5) Copies of any record made under sub-section (1) or sub-section (3) shall forthwith be sent to the nearest Magistrate empowered to take cognizance of the offence, and the owner or occupier of the place searched shall, on application, be furnished, free of cost, with a copy of the same by the Magistrate.
19. इसी प्रकार धारा 100, 102 व 103 भारतीय नागरिक संरक्षा संहिता को भी यहां उद्धरित किया जाना न्यायोचित होगा:- 100. If any District Magistrate, Sub-divisional Magistrate or Magistrate of the first class has reason to believe that any person is confined under such circumstances that the confinement amounts to an offence, he may issue a search-warrant, and the person to whom such warrant is directed may search for the person so confined; and such search shall be made in accordance therewith, and the person, if found, shall be immediately taken before a Magistrate, who shall make such order as in the circumstances of the case seems proper. 102. The provisions of sections 32, 72, 74, 76, 79, 80 and 81 shall, so far as may be, apply to all search-warrants issued under section 96, section 97, section 98 or section 100. 103. (1) Whenever any place liable to search or inspection under this Chapter is closed, any person residing in, or being in charge of, such place, shall, on demand of the officer or other person executing the warrant, and on production of the warrant, allow him free ingress thereto, and afford all reasonable facilities for a search therein. (2) If ingress into such place cannot be so obtained, the officer or other person executing the warrant may proceed in the manner provided by sub-section (2) of section 44. (3) Where any person in or about such place is reasonably suspected of concealing about his person any article for which search should be made, such person may be searched and if such person is a woman, the search shall be made by another woman with strict regard to decency. (4) Before making a search under this Chapter, the officer or other person about to make it shall call upon two or more independent and respectable inhabitants of the locality in which the place to be searched is situate or of any other locality if no such inhabitant of the said locality is available or is willing to be a witness to the search, to attend and witness the search and may issue an order in writing to them or any of them so to do. (5) The search shall be made in their presence, and a list of all things seized in the course of such search and of the places in which they are respectively found shall be prepared by such officer or other person and signed by such witnesses; but no person witnessing a search under this section shall be required to attend the Court as a witness of the search unless specially summoned by it. (6) The occupant of the place searched, or some person in his behalf, shall, in every instance, be permitted to attend during the search, and a copy of the list prepared under this section, signed by the said witnesses, shall be delivered to such occupant or person. (7) When any person is searched under sub-section (3), a list of all things taken possession of shall be prepared, and a copy thereof shall be delivered to such person. (8) Any person who, without reasonable cause, refuses or neglects to attend and witness a search under this section, when called upon to do so by an order in writing delivered or tendered to him, shall be deemed to have committed an offence under section 220 of the Bharatiya Nyaya Sanhita, 2023.
20. Lalita Kumari Vs. Government of Uttar Pradesh (AIR 2014 SC 187) में माननीय उच्चतम न्यायालय द्वारा दिए गए निम्नलिखित मत को यहां उल्लेखित किया जाना न्यायोचित होगा:- 76. Therefore, conducting an investigation into an offence after registration of FIR under Section 154 of the Code is the "procedure established by law" and, thus, is in conformity with Article 21 of the Constitution. Accordingly, the right of the accused under Article 21 of the Constitution is protected if the FIR is registered first and then the investigation is conducted in accordance with the provisions of law. 83. The object sought to be achieved by registering the earliest information as FIR is inter alia two fold: one, that the criminal process is set into motion and is well documented from the very start; and second, that the earliest information received in relation to the commission of a cognizable offence is Erecorded so that there cannot be any embellishment etc., later. 86. The underpinnings of compulsory registration of FIR is not only to ensure transparency in the criminal justice delivery system but also to ensure 'judicial oversight'. Section 157(1) deploys the word 'forthwith'. Thus, any information received under Section 154(1) or otherwise has to be duly informed in the form of a report to the Magistrate. Thus, the commission of a cognizable offence is not only brought to the knowledge of the investigating agency but also to the subordinate judiciary. 88. The registration of FIR either on the basis of the information furnished by the informant under Section 154(1) of the Code or otherwise under Section 157(1) of the Code is obligatory. The obligation to register FIR has inherent advantages: (a) It is the first step to 'access to justice' for a victim. (b) It upholds the 'Rule of Law' inasmuch as the ordinary person brings forth the commission of a cognizable crime in the knowledge of the State. (c) It also facilitates swift investigation and sometimes even prevention of the crime. In both cases, it only effectuates the regime of law. (d) It leads to less manipulation in criminal cases and lessens incidents of 'ante-dates' FIR or deliberately delayed FIR. Conclusion/Directions: 111) In view of the aforesaid discussion, we hold: i)Registration of FIR is mandatory under Section 154 of the Code, if the information discloses commission of a cognizable offence and no preliminary inquiry is permissible in such a situation. ii) If the information received does not disclose a cognizable offence but indicates the necessity for an inquiry, a preliminary inquiry may be conducted only to ascertain whether cognizable offence is disclosed or not. iii) If the inquiry discloses the commission of a cognizable offence, the FIR must be registered. In cases where preliminary inquiry ends in closing the complaint, a copy of the entry of such closure must be supplied to the first informant forthwith and not later than one week. It must disclose reasons in brief for closing the complaint and not proceding futher. iv) The police officer cannot avoid his duty of registering offence if cognizable offence is disclosed. Action must be taken against erring officers who do not register the FIR if information received by him discloses a cognizable offence. v) The scope of preliminary inquiry is not to verify the veracity or otherwise of the information received but only to ascertain whether the information reveals any cognizable offence. vi) As to what type and in which cases preliminary inquiry is to be conducted will depend on the facts and circumstances of each case. The category of cases in which preliminary inquiry may be made are as under: a) Matrimonial disputes/ family disputes b) Commercial offences c) Medical negligence cases d) Corruption cases e) Cases where there is abnormal delay/laches in initiating criminal prosecution, for example, over 3 months delay in reporting the matter without satisfactorily explaining the reasons for delay. The aforesaid are only illustrations and not exhaustive of all conditions which may warrant preliminary inquiry. vii) While ensuring and protecting the rights of the accused and the complainant, a preliminary inquiry should be made time bound and in any case it should not exceed 7 days. The fact of such delay and the causes of it must be reflected in the General Diary entry. viii) Since the General Diary/Station Diary/Daily Diary is the record of all information received in a police station, we direct that all information relating to cognizable offences, whether resulting in registration of FIR or leading to an inquiry, must be mandatorily and meticulously reflected in the said Diary and the decision to conduct a preliminary inquiry must also be reflected, as mentioned above. 112) With the above directions, we dispose of the reference made to us. List all the matters before the appropriate Bench for disposal on merits.
21. माननीय कर्नाटक उच्च न्यायालय के द्वारा पारित Christy Fried Gram Industry and Ors. Vs. State of Karnataka and Ors.;2016 CriLJ 482 में निम्न मत व्यक्त किया गया है:- 22. The points that arise for consideration are that: (1) Whether the investigation and preliminary enquiry prior to registration of FIR is permissible in law? And if not what is the effect? (2) Whether in the absence of alleging offence under Section 7 & 11 of Prevention of Corruption Act, non-public servants (petitioners in Writ Petitions), can be prosecuted (3) Whether the Lokayuktha Police is empowered to initiate proceedings and investigate in respect of food related offences, when under Food Safety and Standards Act, 2006, a separate authority and complete mechanism is provided which has the exclusive jurisdiction to deal with it (4) Search warrant issued and seizure made based on that is vitiated thereby vitiating the entire proceedings as contended by the petitioners? (5) Whether the petitioners have made out a case for quashing the proceedings? 23. My answer to the above points are in favour of the petitioners for the following reasons: Point No.1. Whether the investigation and preliminary enquiry prior to registration of FIR is permissible in law? And if not what is the effect? 24. It is not disputed by the respondent prosecution that in the present case investigation has taken place prior to registration of F.I.R. but learned counsel for Lokayukta claims that it is only a discrete enquiry. 25. An anonymous complaint was filed against the Director of Women and Child Development Department on 5.10.2010. The Superintendent of Police, Lokayuktha, Bangalore City Division entrusted the matter to Smt.H R Radhamani, Dy. S.P for investigation. Accordingly, Smt. Radhamani investigated the matter, and reported vide report dated 30.1.2011 that husband of Smt. Shamala Iqbal, Director of Women and Child Development Department had misused her name and interfered in the work of the department and indulged in corruption. Thereafter Sri Anil Kumar, Inspector of Lokayuktha took over the investigation and submitted his report dated 9.2.2012 to the effect that contents of the complaint are true and to ascertain the further particulars and collect information he listed out as many as 10 places to be raided and the persons named therein. 26. On 7.3.2012 statement of Mrs. Priya Udupi was recorded. The learned counsel for Lokayukta sought to contend initially that it is only a typographical mistake, actually her statement was recorded on 7.3.2013. In the final report dated 2.3.2013, there is a reference with regard to statement of Mrs.Priya Udupi, which falsifies the initial contention of the Lokayukta that it was recorded on 7.3.2013. By way of memo dated 8.9.2015 filed by the prosecution, it is sought to contend that her statement was recorded on 21.3.2012 basing the same on case diary extract. Statement of Mrs. Priya Udupi is produced along with the application filed by the petitioners in the writ petitions on 9.9.2015. It clearly indicates the date as 7.3.2012. Therefore, it cannot be concluded that her statement was recorded on 21.3.2012 on the basis of extract of case diary. 27. Mrs. Priya Udupi was the earlier employee of Christy Fried Gram Industry and she was dismissed from service. Based on the above materials the FIR came to be registered on 8.3.2012 before Karnataka Lokayuktha Police, Bangalore. There is about 18 months' investigation prior to registration of F.I.R. 28. It is true, Lokayuktha has got suo motto power under Section 9(3) of Karnataka Lokayukta Act to investigate a matter on any complaint or on any information. Rule 5(3) of Karnataka Lokayukta Act specifies, all complaints, even if it is not submitted in the prescribed format shall be placed before Lokayukta or Upa Lokayukta as the case may be. In the instant case, no such procedure is adopted, instead, the Lokayukta Police themselves assumed jurisdiction and started enquiry against the above legal provisions. 29. It is the contention of the Lokayukta, they had conducted discrete preliminary enquiry to ascertain the truth. Prior to the pronouncement of judgment in Lalita Kumari vs., Government of U P & others, (2014) 2 SCC 1, there is neither any provision under Code of Criminal Procedure nor any settled law providing for conducting preliminary enquiry. However, after the pronouncement in the above case, preliminary enquiry can be conducted not exceeding 7 days. In this regard, reliance is placed on the decision in State of UP vs., Bhagwant Kishore Joshi, AIR 1964 SC 221. In para 8 of the judgment itself, the investigation stated to consist the following steps: i. Proceeding to the spot, il. Ascertainment of the facts and circumstances of the case, iii. Discovery and arrest of the suspected offender, iv. Formation of opinion. Collection of evidence, v. In the instant case, Dy. S.P Radhamani conducted the investigation, made note, collected documents and submitted report and further investigation was taken over by Mr.Anilkumar who seized the documents from DWCD and recorded the statement of Ms.Priya Udupi, which does not fall under the definition of preliminary enquiry. The preliminary enquiry is to be without questioning any witness and without making any notes from the documents seized. 30. The learned counsel for the petitioners placed reliance on decision in Rajeevan vs., State of Kerala reported in CDJ 2003 SC 323. The relevant portion in Para-12 of the judgment is to the following effect:Delay in lodging FIR quite often results in embellishment which is a creature of afterthought. On account of delay the report not only gets bereft of the advantage of spontaneity, danger creeps in of the introducing of coloured version exaggerated account, concocted story as a result of deliberation and consultation." 31. The petitioners in the writ petitions placed reliance on decision in Lalita Kumari vs., State of U.P. & others (2014) 2 SCC 1 and contended that registration of F.I.R before conducting investigation is mandatory. The Hon'ble Supreme Court dealt with a direct question in the aforesaid decision that, whether a police officer is bound to register a first information report upon receiving any information relating to commission of a cognizable offence under Section 154 of Code of Criminal Procedure, 1973 or the police officer has the power to conduct a `preliminary inquiry' in order to test the veracity of such information before registering the same. The Supreme Court took note of observation of the Committee on Reforms of Criminal Justice System in Para-102 which is as follows: 7.19.1 According to the Section 154 of the Code of Criminal Procedure the officer incharge of the police station is mandated to register every information oral or written relating to the commission of cognizable offence. Non registration of cases is a serious complaint against the police. Besides, the complainant gets an opportunity to consult his friends, relatives and sometimes even lawyers and often tend to exaggerate the crime and implicate innocent persons. This eventually has the adverse effect at the trial. The information should be reduced in writing by the SH, if given orally, without any loss of time so that the first version of the alleged crime comes on record. 7.20.11 It has come to the notice of the Committee that even in cognizable cases quite often the police officers do not entertain the complaint and send the complainant away saying that the offence is not cognizable. Sometimes, the police twist facts to bring the case within the cognizable category even though it is non cognizable, due to political or other pressures or corruption. This menace can be stopped by making it obligatory on the police officer to register every complaint received by him. Breach of this duty should become an offence punishable in law to prevent misuse of the power by the police officer. The Hon'ble Supreme Court has held in Para-120.7 that while ensuring and protecting the rights of the accused and the complainant, a preliminary inquiry should be made time-bound and in any case it should not exceed 7 days. The fact of such delay and the causes of it must be reflected in the General Diary entry. It is further held in Para-120.8 that since the General Diary/Station Diary/Daily Diary is the record of ali information received in a police station, Supreme Court directed that all information relating to cognizable offences, whether resulting in registration of FIR or leading to an inquiry, must be mandatorily and meticulously reflected in the said diary and the decision to conduct a preliminary inquiry must also be reflected. 32. The learned counsel for the petitioners placed reliance on the decision in L Shankar Murthy & others vs., State by Lokayuktha Police, reported in 2012(5) Kar.L.J. 545 where this Court has dealt with the effect of investigation prior to registration therein. Paras-33, 35, 45 and 46 read as follows: "33. The scheme of Cr PC also makes it clear that, Section 157 of Cr PC gives power to the police officer to take up investigation only after sending a report to the Magistrate, and power to take cognizance of such offence where the officer concerned, from the information received or otherwise, has reason to suspect the commission of an offence which he is empowered to investigate under Section 156 of Cr PC, he shall follow the requirements of Section 157 before embarking upon the investigation. It is, therefore, clear from the aforesaid provisions of CrPC that the police officer concerned cannot proceed with the investigation without first registering the case upon the information received by him. 35. In the light of the aforesaid position in the law laid down by the Apex Court in particular in the aforementioned cases, the entire proceeding leading to conducting the seizure panchanama even without registering the cases as required under Section 154 of the Cr.P.C. is illegal, contrary to law and is in violation of the mandatory provisions of the Cr.P.C. and the act on the part of the Police Officer concerned is nothing but an act which could be termed as abuse of the process of law. 45. ....as of now, the settled position in law is registering the case upon the information received is sine qua non before proceeding to take up the investigation. 46. Thus, the entire procedure followed by the concerned Police Officer is an abuse of the process of law and, therefore, I have no hesitation in agreeing with the contentions put forward by the learned Counsel for the petitioners that these cases are fit enough to be brought within the rarest of rare cases and in order to prevent abuse of the process of law and to meet the ends of justice, exercise of inherent power conferred under Section 482 of the Cr.P.C., therefore, becomes imperative and inevitable". 33. It is to be mentioned here that the aforesaid Shankaramoorthy case was challenged by the Lokayuktha police before the Hon'ble Supreme Court and the Apex court declined to interfere. 34. The petitioners further placed reliance on the decision in Girishchandra & another v. State of Lokayuktha Police, Yadgir, reported in 2013(5) Kar.L.J. 470 (DB) and the Hon'ble Division Bench of this Court has held as follows: "In a situation where an offence is committed right in the presence of a Police Officer, it would be imprudent to insist that he should rush to the police station to record the FIR. The Police Officer should immediately act, like apprehending the accused, sending the victim to medical treatment etc., and thereafter registration of FIR would be an ideal investigation procedure. Otherwise, in all other type of cases, registration of FIR is mandatory since an FIR is to be sent to the Court at the earliest stage, so that no manipulating and tampering of facts would be possible". 35. The learned counsel for Lokayukta has submitted that the nature of enquiry before registration of FIR was discrete in nature and without the knowledge of the petitioners thereby they are not prejudiced. Relying upon the decision in State of M.P & others v. Shri Ram Singh, reported in AIR 2000 SC 870 it is submitted that every illegality or irregularity in investigation does not vitiate the entire proceedings. The point involved in the above citation was the order of the Superintendent of Police was in typed pro forma, thereby whether there was application of mind by the Superintendent of Police in authorizing the junior officer to investigate. The said decision did not deal with a situation where investigation is done prior to registration of FIR and hence has no relevance to the point in issue. 40. From the above, it is clear that the prosecution is not justified in conducting investigation before registration of FIR in the guise of preliminary enquiry and investigation for a period of about 18 months is beyond the 7 days period said to be permissible as laid down in Lalita Kumari's case referred to supra. 41. FIR in a criminal case is a vital and valuable piece of evidence though not a substantive piece of material. The object of registering FIR in respect of commission of an offence is to obtain early information regarding the nature of crime and names of the culprits and part played by them as well as names of the eye-witnesses present at the time of incident. Delay in lodging the FIR, loses the advantage of spontaneity, danger creeps in of the introduction of coloured version, exaggerated account or concocted story as a result of large number of consultations/deliberations. Promptly lodged FIR reflects first hand information as to what has happened, and who was responsible for such an offence. 42. In the circumstances, the Lokayukta police have committed grave error of law in proceeding to conduct a preliminary enquiry for a substantial period of about 18 months before registering the FIR and such a preliminary enquiry without registering the FIR is impermissible in law vitiating the entire proceedings and it is abuse of process of the Court. Accordingly, the Point No.1 is answered. 29. That in matter of Anju Chaudhary Vs. State of Uttar Pradesh [Criminal Appeal No. 2039 OF 2012], it was held that, The First Information Report is a very important document, besides that it sets the machinery of criminal law in motion. It is a very material document on which the entire case of the prosecution is built. Upon registration of FIR, beginning of investigation in a case, collection of evidence during investigation and formation of the final opinion is the sequence which results in filing of a report under Section 173 of the Code. Since, the registration of FIR sets the machinery of criminal law in motion, and thereafter investigation begins, in such circumstances it is not permissible to investigate, search and seizure, arrest and detention before the registration of FIR.
22. इस प्रकरण में विचारणीय बिंदुओं को दृष्टिगत रखते हुए दंड प्रक्रिया संहिता 1973 की धारा 50 (धारा 52 बीएनएसएस) को यहां उद्धरित किया जाना न्यायोचित होगा:- 50. Person arrested to be informed of grounds of arrest and of right to bail. (1) Every police officer or other person arresting any person without warrant shall forthwith communicate to him full particulars of the offence for which he is arrested or other grounds for such arrest. (2) Where a police officer arrests without warrant any person other than a person accused of a non-bailable offence, he shall inform the person arrested that he is entitled to be released on bail and that he may arrange for sureties on his behalf.
23. Vihaan Kumar Versus State of Haryana & Anr., SLP No. 13320/2024; order dated 07.02.2025. में माननीय उच्चतम न्यायालय द्वारा पारित उक्त निर्णय के सुसंगत भाग को यहां उद्धरित किया जाना न्यायोचित होगा:- CONCLUSIONS 21. Therefore, we conclude: a) The requirement of informing a person arrested of grounds of arrest is a mandatory requirement of Article 22(1): b) The information of the grounds of arrest must be provided to the arrested person in such a manner that sufficient knowledge of the basic facts constituting the grounds is imparted and communicated to the arrested person effectively in the language which he understands. The mode and method of communication must be such that the object of the constitutional safeguard is achieved: c) When arrested accused alleges non-compliance with the requirements of Article 22(1), the burden will always be on the Investigating Officer/Agency to prove compliance with the requirements of Article 22(1): d) Non-compliance with Article 22(1) will be a violation of the fundamental rights of the accused guaranteed by the said Article. Moreover, it will amount to a violation of the right to personal liberty guaranteed by Article 21 of the Constitution. Therefore, non-compliance with the requirements of Article 22(1) vitiates the arrest of the accused. Hence, further orders passed by a criminal court of remand are also vitiated. Needless to add that it will not vitiate the Investigation, charge sheet and trial. But, at the same time, filing of chargesheet will not validate a breach of constitutional mandate under Article 22(1): e) When an arrested person is produced before a Judicial Magistrate for remand, it is the duty of the Magistrate to ascertain whether compliance with Article 22(1) and other mandatory safeguards has been made: and 1) When a violation of Article 22(1) is established, it is the duty of the court to forthwith order the release of the accused. That will be a ground to grant bail even if statutory restrictions on the grant of bail exist. The statutory restrictions do not affect the power of the court to grant bail when the violation of Articles 21 and 22 of the Constitution is established.
24. इस प्रकरण में पुलिस निरीक्षक भ्रष्टाचार निरोधक विभाग को सूत्र सूचना जो किसी प्रकार से लिखित में नहीं है, से यह ज्ञात हुआ कि नगर निगम ग्रेटर के अधिकारी और कर्मचारी नगर निगम के ठेकेदारों से उनके कार्यों के बिलों के भुगतान करने की एवज में 2 से 3 प्रतिशत की धन राशि बतौर कमीशन रिश्वत के रूप में ले रहे हैं, इस सूचना के आधार पर याची/अभियुक्त अचलेश्वर मीणा, वित्तीय सलाहकार, नगर निगम ग्रेटर, गोविन्द्र अग्रवाल उर्फ गोपी अग्रवाल, धनकुमार अग्रवाल, अनिल अग्रवाल, गंगाराम मीणा तथा अभिषेक जैन उर्फ टीटू, गंगाराम मीणा, यतेन्द्र सांखला के मोबाइल नंबर को अन्तावरोध पर लिया गया, उसके आधार पर यह पाया कि याची/अभियुक्त धनकुमार से रिश्वत राशि लेकर अपने घर में गया है, तथा उसके कब्जे से उक्त रिश्वत राशि बरामद हो सकती है इस पर भ्रष्टाचार निरोधक विभाग द्वारा याची/अभियुक्त के घर में प्रवेश किया गया तो रिश्वत की कोई राशि बरामद नहीं हुई। तलाशी के दौरान गोविन्द्र कुमार अ्रगवाल उर्फ गोपी अग्रवाल आया और उसके द्वारा लाई गई जुलाई 2020 से दिनांक 29.12.2021 तक सिविल कान्ट्रेक्टर्स के निर्माण कार्यों की बकाया राशि की सूची से अन्वेषण के दौरान यह स्पष्ट नहीं हुआ कि उक्त सूची में रिश्वत की राशि की कोई मांग हो या प्राप्त की गई हो। याची/अभियुक्त की तलाशी के दौरान कंप्यूटर से निकाली गई सूची जिसमें कॉन्ट्रेक्टर के नाम लिखे हुए थे और अंक लिखे हुए थे, जब्त की गई। उससे भी यह प्रथम दृष्ट्या स्पष्ट नहीं हुआ है कि कोई रिश्वत की राशि की मांग याची/अभियुक्त द्वारा की गई हो या प्राप्त की गई हो। याची/अभियुक्त के घर की तलाशी दिनांक 07.01.2022 को 11.00 पी.एम पर की गई, उससे रिश्वत की कोई राशि बरामद नहीं हुई है। सहअभियुक्त धनकुमार कोई रिश्वत की राशि लाया हो उसकी पुष्टि में याची/अभियुक्त से कोई बरामदगी नहीं है।
25. अभियोजन द्वारा यह कहानी बनाई गई है कि याची/अभियुक्त ने फर्मों के बिल के भुगतान की एवज में कमीशन की राशि प्राप्त करने के लिए अनिल अग्रवाल को अधिकृत किया और उसने कमीशन में लाई गई राशि 11 लाख 95 हजार रुपए अपने घर में रखे। उक्त 11 लाख 95 हजार रुपए कौन-कौनसी फर्मों से, कितनी राशि किस किस कार्य के लिए कमीशन के रूप में प्राप्त की गई इसके संबंध में कोई विस्तृत अनुसंधान इस प्रकरण में नहीं हुआ है। अभियोजन कहानी में यह भी बताया गया है कि उक्त 11 लाख 95 हजार रुपए की राशि को लेने के लिए सुमित शर्मा अनिल अग्रवाल के घर पर गया और उसकी पत्नी से उक्त रुपए लेकर अपने कार्यालय में रख दिए और याची/अभियुक्त ने सुमित शर्मा को 3 लाख 50 हजार रुपए विद्युत ठेकेदार महेन्द्र झा से दिलवाए थे। उक्त राशि भी सुमित शर्मा ने अपने कार्यालय में रखी। उक्त 11 लाख 95 हजार रुपए सुमित शर्मा ने डायमेंशन इंफ्रास्ट्रक्चर प्राईवेट लिमिटेड के ऑफिस में लाकर श्री लक्ष्मीकांत महावर को दे दी और उक्त 11 लाख 95 हजार रुपए की राशि में से 11 लाख 45 हजार रुपए लक्ष्मीकांत महावर ने कैलाश चन्द मीणा को दे दिए और 3 लाख 50 हजार रुपए की राशि में से 2 लाख रुपए की राशि कंपनी में खर्च कर दी। लक्ष्मीकांत महावर ने कैलाश चन्द मीणा को 11 लाख 95 हजार रुपए की राशि में से 11 लाख 45 हजार रुपए दिए हों इस संबंध में कैलाश चन्द मीणा से इस प्रकरण में कोई बरामदगी नहीं हुई है। विद्युत ठेकेदार महेश झा से सुमित शर्मा ने 3 लाख 50 हजार रुपए लेकर लक्ष्मीकान्त महावर को दिए थे, यदि वह रिश्वत की राशि होती तो वह 2 लाख रुपए लक्ष्मीकान्त महावर कंपनी के कार्यों में खर्च नहीं करता। 11 लाख 95 हजार रुपए की राशि में से शेष बचे हुए 50 हजार रुपए और 3 लाख 50 हजार रुपए की राशि में से खर्चा लगभग 2 लाख निकाल कर शेष बचे 1.5 लाख रुपए, कुल 2 लाख रुपए लक्ष्मीकान्त महावर की अलमारी में से जब्त हुए हैं। सर्वप्रथम प्रथमदृष्टया इस प्रकरण में यह स्प्ष्ट नहीं हुआ कि अनिल अग्रवाल ने कौन-कौनसी फर्म से कितनी-कितनी राशि कमीशन के रूप में रिश्वत के लिए ली और उसके लिए याची/अभियुक्त ने अनिल अग्रवाल को अधिकृत किया हो। उक्त राशि 11 लाख 95 हजार रुपए कैसे और किन आधारों पर हुई यह स्पष्ट नहीं है। अनिल कुमार की पत्नी से सुमित शर्मा द्वारा राशि लाना, सुमित शर्मा द्वारा उक्त राशि और विद्युत ठेकेदार महेश झा से ली गई 3.5 लाख रुपए की राशि को लेकर कंपनी के ऑफिस में लक्ष्मीकान्त महावर को देना और लक्ष्मीकान्त महावर द्वारा 11 लाख 95 हजार रुपए की राशि में से 11 लाख 45 हजार रुपए कैलाश चन्द मीणा को देना जो कैलाश चन्द मीणा से जब्त नहीं होना और 3.5 लाख रुपए में से 2 लाख रुपए लक्ष्मीकान्त द्वारा कंपनी के संबंध में खर्च करना और शेष बचे 2 लाख रुपए लक्ष्मीकान्त महावर से जब्त होने के पीछे याची/अभियुक्त था या उक्त रिश्वत राशि उसके द्वारा ली गई थी, इस प्रकार की कोई साक्ष्य टेलीफोन वार्ताओं से, लिए गए फोटोग्राफ से और वीडियो से सामने नहीं आई है।
26. इस प्रकरण में यह स्वीकृत स्थिति है कि दिनांक 08.01.2022 रोजनामचा आम रपट संख्या 208 समय 5.15 प्रथम सूचना रिपोर्ट संख्या 5/2022 दर्ज की गई थी, उससे पूर्व ही दिनांक 07.01.2022 को 10.30 ए.एम पर भ्रष्टाचार निरोधक विभाग द्वारा बिना किसी तलाशी वारंट के या बिना किसी पुख्ता सबूत और सूचना के आधार पर याची/अभियुक्त के मकान में अनाधिकृत प्रवेश कर तलाशी ली, इस संबंध में तलाशी वारंट प्राप्त नहीं किया गया। याची/अभियुक्त के कब्जे से कोई रिश्वत की राशि बरामद नहीं हुई। दिनांक 07.01.2022 को 10.35 पी.एम पर अभियुक्त को गिरफ्तार किया गया व दिनांक 08.01.2022 को 5.00 पी.एम. पर याची/अभियुक्त को मजिस्ट्रेट के निवास पर पहुंचकर दिनांक 11.01.2022 तक उसे पुलिस अभिरक्षा में लिया गया। दिनांक 08.01.2022 को अभियुक्त को 5.00 पी.एम. पर मजिस्ट्रेट के समक्ष पेश करने के पश्चात इस प्रकरण में दिनांक 08.01.2022 को 5.15 पर प्रथम सूचना रिपोर्ट दर्ज करायी गयी। एसी स्थिति में यह स्पष्ट है कि इस प्रकरण में प्रथम सूचना रिपोर्ट दर्ज किये जाने से पूर्व प्रार्थी/अभियुक्त के घर की तलाशी बिना वारंट के ली गई, जब्ती की गयी व अभियुक्त को गिरफ्तार किया गया व मजिस्ट्रेट के समक्ष पुलिस अभिरक्षा वारंट लेने के लिए प्रस्तुत किया गया। प्रथम सूचना रिपोर्ट दर्ज किये जाने से पूर्व ही बिना किसी पुख्ता साक्ष्य व सबूत के बिना तलाशी वारंट व सक्षम प्राधिकारी से तलाशी वारंट प्राप्त किये बिना प्रार्थी/अभियुक्त के घर में घुसकर तलाशी लिया जाना, दस्तावेज जब्त किया जाना, उसे गिरफ्तार किया जाना, उसको प्रथम सूचना रिपोर्ट दर्ज करने से पूर्व मजिस्ट्रेट के समक्ष पुलिस अभिरक्षा के लिए प्रस्तुत किया जाना, उपरोक्त विनिश्चयों व विधि द्वारा प्रतिपादित सिद्धांतों के तहत भ्रष्टाचार निरोधक विभाग का उक्त कृत्य विधि के अनुरूप नहीं माना जा सकता है। अत: उक्त कृत्य याची/अभियुक्त के भारतीय संविधान के अनुच्छेद 21 में प्रदत्त निजता के अधिकार का उल्लंघन माना जा सकता है।
27. इस प्रकरण में याची/अभियुक्त को दिनांक 07.01.2022 को 10.35 पी.एम. पर गिरफ्तार किया गया। उक्त फर्द गिरफ्तारी का अवलोकन करें तो याची/अभियुक्त को किन आधारों पर गिरफ्तार किया गया, उसकी गिरफ्तारी के क्या कारण हैं, उसे प्रकरण में बचाव के लिए विधिक सलाह अधिवक्ता से लेने का अधिकार है, इन तथ्यों के संबंध में बिल्कुल भी अवगत नहीं करवाया गया, ना ही इन तथ्यों का उल्लेख याची/अभियुक्त की फर्द गिरफ्तारी दिनांक 07.01.2022 में किया गया है। केवल याची/अभियुक्त की गिरफ्तारी की सूचना याची/अभियुक्त के बताए अनुसार उसके पुत्र अभय मीणा को मोबाईल पर दिया जाना बताया गया है। उसके पुत्र अभय मीणा को मोबाईल पर सूचना दी गयी या नही, इसके संबंध में कोई साक्ष्य प्रस्तुत नही हुई है। यदि यह माना भी जावे कि याची/अभियुक्त की गिरफ्तारी की सूचना उसके पुत्र अभय मीणा को दी गई थी, तब भी याची/अभियुक्त को गिरफ्तारी के आधार व कारण के बारे में अवगत कराया गया हो, यह इस प्रकरण में स्पष्ट नही है।
28. इस प्रकरण में यह स्पष्ट है कि बिना प्रथम सूचना रिपोर्ट के भ्रष्टाचार निरोधक विभाग द्वारा याची/अभियुक्त के पास रिश्वत की राशि होने की पुष्टि पुख्ता सबूत के बिना, तलाशी वारंट के बिना उसके घर में प्रवेश कर घर की तलाशी ली और दस्तावेज की जब्ती की और रिश्वत की राशि नहीं मिलने पर और उसे खुर्द-बुर्द करने के तथ्य कहे। याची/अभियुक्त ने उक्त रिश्वत की राशि कहां खुर्द-बुर्द की, इसके संबंध में कोई साक्ष्य नहीं जुटाई गयी है। याची/अभियुक्त के घर की तलाशी लेते समय याची/अभियुक्त के निवास के आसपास के जो स्थानीय दो साक्षीगण हैं, उनकी उपस्थिति में नियमानुसार तलाशी ली जानी चाहिए, लेकिन इस प्रकरण में इस प्रकार तलाशी नहीं ली गयी। केवल पुलिसकर्मी देवेन्द्र सिंह व मनीष सिंह की उपस्थिति में तलाशी ली गयी है, जो स्वतंत्र साक्षी नहीं माने जा सकते हैं। इस प्रकरण में जब्ती की कार्यवाही सक्षम क्षेत्राधिकार वाले मजिस्ट्रेट को भेजी गयी हो, यह स्पष्ट नही है। याची/अभियुक्त के कब्जे से मिली सूची व दस्तावेज लिये जाकर प्राप्त किये गये हों, जो किसी अपराध को घटित होने को स्पष्ट करते हों, इस प्रकार के कोई तथ्य अन्वेषण के दौरान नहीं जुटाये गये हैं। ऐसी स्थिति में उपरोक्त विवेचनानुसार भ्रष्टाचार निरोधक विभाग द्वारा की गयी कार्यवाही धारा 100, धारा 102 व धारा 103 दण्ड प्रक्रिया संहिता में वर्णित प्रावधानों के तहत उक्त प्रावधानों के उल्लंघन के फलस्वरूप की गई कार्यवाही मानी जा सकती है। केवल व्यक्तियों के टेलीफोन को टैप करने में किए गए कथन के आधार पर याची/अभियुक्त के विरुद्ध मामला बनाया गया है और उक्त कथनों से भी याची/अभियुक्त के विरुद्ध आरोपित अपराध प्रथमदृष्टया बनने नहीं पाए गए हैं। इस संबंध में फर्द गिरफ्तारी में कोई आधार नहीं लिए गए हैं, याची/अभियुक्त के विरुद्ध आरोपित अपराध अधिकतम 7 वर्ष से दंडनीय अपराध है, ऐसे स्थति में Arnesh Kumar Vs. State of Bihar (2014) 8 SCC 273 विनिश्चय में माननीय उच्चतम न्यायालय द्वारा अभिनिर्धारित सिद्धांत तथा सीआरपीसी की धारा 41ए मेंे वर्णित प्रावधानों के तहत याची/अभियुक्त को गिरफ्तारी से पूर्व कोई नोटिस नहीं दिया गया है। धारा 50(1) दंड प्रक्रिया संहिता के तहत याची/अभियुक्त को गिरफ्तारी के आधारों व कारणों का व उसकी पसंद के अधिवक्ता से विधिक सलाह लेने का अधिकार नहीं दिया गया है। बिना किसी न्यायसंगत व उचित आधार के रिश्वत की राशि की मांग का आरोप, रिश्वत की राशि जब्त किए बिना, प्रथम सूचना रिपोर्ट दर्ज किए बिना किसी न्यायसंगत उचित आधार के याची/अभियुक्त को गिरफ्तार किया जाना धारा 41, 41ए और 50 सीआरपीसी (धारा 35 और 47 बीएनएसएस) सपठित भारतीय संविधान के अनुच्छेद धारा 21 तथा 22 का उल्लंघन होने के कारण से याची/अभियुक्त की गिरफ्तारी और उसका निरुद्धीकरण विधि की दृष्टि से पूर्णत: अवैधानिक, असंवैधानिक माना जा सकता है।
विचारणीय बिन्दु संख्या-2
क्या धारा 5 भारतीय टेलीग्राफ अधिनियम, 1885 सपठित इंडियन टेलीग्राफ रूल्स, 1951 के नियम 419 सपठित भारतीय सूचना प्रौद्योगिकी अधिनियम, 2000 की धारा 69 के तहत याची/अभियुक्त के टेलीफोन टैप और फोटोग्राफों तथा वीडियो की अनुमति विधि अनुरूप सक्षम प्राधिकारी द्वारा दी गई है? और यदि नहीं, तो क्या याची/अभियुक्त के भारतीय संविधान के अनुच्छेद 19 व 21 में प्रदत्त स्वतंत्रता व निजता के अधिकार का उल्लंघन हुआ है?
29. उपरोक्त विचारणीय बिंदु को विनिश्चित किए जाने से पूर्व सुसंगत धाराओं व विनिश्चयों को यहां अभिनिर्धारित किया जाना न्यायोचित प्रतीत होता है:- धारा 5 भारतीय टेलीग्राफ अधिनियम, 1885:- 5. Power for Government to take possession of licensed telegraphs and to order interception of messages.--(1) On the occurrence of any public emergency, or in the interest of the public safety, the Central Government or a State Government or any officer specially authorised in this behalf by the Central Government or a State Government may, if satisfied that it is necessary or expedient so to do, take temporary possession (for so long as the public emergency exists or the interest of the public safety requires the taking of such action) of any telegraph established, maintained or worked by any person licensed under this Act. (2) On the occurrence of any public emergency, or in the interest of the public safety, the Central Government or a State Government or any officer specially authorised in this behalf by the Central Government or a State Government may, if satisfied that it is necessary or expedient so to do in the interests of the sovereignty and integrity of India, the security of the State, friendly relations with foreign States or public order or for preventing incitement to the commission of an offence, for reasons to be recorded in writing, by order, direct that any message or class of messages to or from any person or class of persons, or relating to any particular subject, brought for transmission by or transmitted or received by any telegraph, shall not be transmitted, or shall be intercepted or detained, or shall be disclosed to tho Government making the order or an officer thereof mentioned in the order: Provided that press messages intended to be published in India of correspondents accredited to the Central Government or a State Government shall not be intercepted or detained, unless their transmission has been prohibited under this sub-section. धारा 69 सूचना प्रौद्योगिकी अधिनियम:- 69. Power to issue directions for interception or monitoring or decryption of any information through any computer resource. - (1) Where the Central Government or a State Government or any of its officers specially authorised by the Central Government or the State Government, as the case may be, in this behalf may, if satisfied that it is necessary or expedient to do in the interest of the sovereignty or integrity of India, defence of India, security of the State, friendly relations with foreign States or public order or for preventing incitement to the commission of any cognizable offence relating to above or for investigation of any offence, it may, subject to the provisions of sub-section (2), for reasons to be recorded in writing, by order, direct any agency of the appropriate Government to intercept, monitor or decrypt or cause to be intercepted or monitored or decrypted any information generated, transmitted, received or stored in any computer resource. नियम 419ए भारतीय टेलीग्राफ नियम, 1951:- "(2)Any order issued by the competent authority under sub-rule (1) shall contain reasons for such direction and a copy of such order shall be forwarded to the concerned Review Committee within a period of seven working days. (3) While issuing directions under sub-rule (1) the officer shall consider possibility of acquiring the necessary information by other means and the directions under sub-rule (1) shall be issued only when it is not possible to acquire the information by any other reasonable means. (5) The directions shall specify the name and designation of the officer or the authority to whom the intercepted message or class of messages is to be disclosed and also specify that the use of intercepted message or class of messages shall be subject to the provisions of sub-section (2) of Section 5 of the said Act (16) The Central Government and the State Government, as the case may be, shall constitute a Review Committee. The Review Committee to be constituted by the Central Government shall consist of the following, namely: (a) Cabinet Secretary - Chairman (b) Secretary to the Government of India Incharge, Legal Affairs Member (c) Secretary to the Government of India, Department of Telecommunications Member The Review Committee to be constituted by a State Government shall consist of the following, namely: (a) Chief Secretary - Chairman (b) Secretary Law/Legal Remembrancer Incharge, Legal Affairs Member (c) Secretary to the State Government (other than the Home Secretary) Member (17) The Review Committee shall meet at least once in two months and record its findings whether the directions issued under sub-rule (1) are in accordance with the provisions of sub-section (2) of Section 5 of the said Act. When the Review Committee is of the opinion that the directions are not in accordance with the provisions referred to above it may set aside the directions and orders for destruction of the copies of the intercepted message or class of messages. (18) Records pertaining to such directions for interception and of intercepted messages shall be destroyed by the relevant competent authority and the authorized security and Law Enforcement Agencies every six months unless these are, or likely to be, required for functional requirements.
30. माननीय उच्चतम न्यायालय द्वारा अपने विनिश्चय People's Union for Civil Liberties (PUCL) Vs. Union of India & Anr., (1997) 1 SCC 301 में यह अभिनिर्धारित किया है कि:- "26. Learned Counsel assisting us in this case have not seriously challenged the constitutional vires of Section 5(2) of the Act. In this respect it would be useful to refer to the observations of this Court in Hukam Chand Shyam Lai v. Union of India and Ors.: Section 5(1) if properly construed, does not confer unguided and unbridled power on the Central Government/State Government specially authorised officer to take possession of any telegraph. Firstly, the occurrence of a "public emergency" is the sine qua non for the exercise of power under this section. As a preliminary step to the exercise of further jurisdiction under this section the Government or the authority concerned must record its satisfaction as to existence of such an emergency. Further, the existence of the emergency which is a pre-requisite for the exercise of power under this section, must be a 'public emergency and not any other kind of emergency. The expression 'public emergency has not been defined in the statute, but contours broadly delineating its scope and features are discernible from the section which as to be read as a whole. In Sub-section (1) the phrase 'occurrence of any public emergency is connected with and is immediately followed by the phrase "or in the interests of the public safety". These two phrases appear to take colour from each other. In the first part of Sub-section (2) those two phrases again occur in association with each other, and the context further clarifies with amplification that a 'public emergency within the contemplation of this section is one which raises problems concerning the interest of the public safety, the sovereignty and integrity or India, the security of the State, friendly relations with foreign States of public order or the prevention of incitement to the commission of al offence. It is in the context of these matters that the appropriate authority has to form an opinion with regard to the occurrence of a 'public emergency" with a view to taking further action under this section. Economic emergency is not one of those matters expressly mentioned in the statute. Mere 'economic emergency-as the High Court calls it may not necessarily amount to a 'public emergency and justify action under this section unless it raises problems relating to the matters indicated in the section. "28. Section 5(2) of the Act permits the interception of messages in accordance with the provisions of the said Section. "Occurrence of any public emergency" or "in the interest of public safety are the sine qua non. for the application of the provisions of Section 5(2) of the Apt. Unless a public emergency has occurred or the interest of public safety demands, the authorities have no jurisdiction to exercise the powers under the said Section. Public emergency would mean the prevailing of a sudden condition or state of affairs affecting the people at large calling for immediate action. The expression "public safety" means the state or condition of freedcm from danger or risk for the people at large. When either of these two conditions are not in existence, the Central Government or a State Government or the authorised officer cannot resort to telephone tapping even though there is satisfaction that it is necessary or expedient so to do in the interests of sovereignty and integrity of India etc. In other words, even if the Central Government is satisfied that it is necessary or expedient so to do in the interest of the sovereignty and integrity of India or the security of the State or friendly relations with sovereign States or public order or for preventing incitement to the commission of an offence, it cannot intercept the messages or resort to telephone tapping unless a public emergency has occurred or the interest of public safety or the existence of the interest of public safety requires. Neither the occurrence of public emergency nor the interest of public safety are secretive conditions or situations. Either of the situations would be apparent to a reasonable person. 29. The first step under Section 5(2) of the Act, therefore, is the occurrence of any public emergency of the existence of a public-safety interest. Thereafter the competent authority under Section 5(2) of the Act is empowered to pass an order of interception after recording its satisfaction that it is necessary or expedient so to do in the interest of (i) sovereignty and integrity of India, (ii) the security of the State, (iii) friendly relations with foreign States, (iv) public order or (v) for preventing incitement to the commission of an offence. When any of the five situations mentioned above to the satisfaction of the competent authority require then the said authority may pass the order for interception of messages by recording reasons in writing for doing so. 30. The above analysis of Section 5(2) of the Act shows that so far the power to intercept messages/conversations is concerned the Section clearly lays-down the situations/conditions under which it can be exercised. But the substantive law as laid down in Section 5(2) of the Act must have procedural backing so that the exercise of power is fair and reasonable. The said procedure itself must be just, fair and reasonable. It has been settled by this Court in Maneka Gandhi v. Union of India, that "procedure which deals with the modalities of regulating, restricting or even rejecting a fundamental right falling within Article 21 has to be fair, not foolish, carefully designed to effectuate, not to subvert, the substantive right itself. Thus, understood, "procedure" must rule out anything arbitrary, freakish or bizarre. A valuable constitutional right can be canalised only by civilised processes". 31. We are of the view that there is considerable force in the contention of Mr. Rajinder Sachar, Mr. Kapil Sibal and Dr. Rajiv Dhawan that no procedure has been prescribed for the exercise of the power under Section 5(2) of the Act. It is not disputed that no rules have been framed under Section 7(2)(b) of the Act for providing the precautions to be taken for preventing the improper interception or disclosure of messages. In the absence of just and fair procedure for regulating the exercise of power under Section 5(2) of the Act, it is not possible to safeguard the rights of the citizens guaranteed under Articles 19(1)(a) and 21 of the Constitution of India. The CBI investigation has revealed several lapses in the execution of the orders passed under Section 5(2) of the Act. Paras 21 and 22 of the report have already been quoted in the earlier part of this judgment."
31. माननीय उच्चतम न्यायालय द्वारा अपने विनिश्चय Kharak Singh v/s State of Uttar Pradesh का सुसंगत भाग यहां उद्धरित किया जाना न्यायोचित होगा:- "In an uncivilized society where there are no inhibitions, only physical restraints may detract from personal liberty, but as civilization advances the psychological restraints are more effective than physical ones. The scientific methods used to condition a man's mind are in a real sense physical restraints, for they engender physical fear channelling one's actions through anticipated and expected grooves. So also the creation of conditions which necessarily engender inhibitions and fear complexes can be described as physical restraints. Further, the right to personal liberty takes in not only a right to be free from restrictions placed on his movements, but also free from encroachments on his private life. It is true our Constitution does not expressly declare a right to privacy as a fundamental right, but the said right is an essential ingredient of personal liberty. Every democratic country sanctifies domestic life; it is expected to give him rest, physical happiness, peace of mind and security. In the last resort, a person's house, where he lives with his family, is his "castle"; it is his rampart against encroachment on his personal liberty. The pregnant words of that famous Judge, Frankfurter J., in Wolf v. Colorado [[1949] 238 US 25] pointing out the importance of the security of one's privacy against arbitrary intrusion by the police, could have no less application to an Indian home as to an American one. If physical restraints on a person's movements affect his personal liberty, physical encroachments on his private life would affect it in a larger degree. Indeed, nothing is more deleterious to a man's physical happiness and health than a calculated interference with his privacy. We would, therefore, define the right of personal liberty in Article 21 as a right of an individual to be free from restrictions or encroachments on his person, whether those restrictions or encroachments are directly imposed or indirectly brought about by calculated measures. If so understood, all the acts of surveillance under PART D Regulation 236 infringe the fundamental right of the petitioner under Article 21 of the Constitution."19 (emphasis supplied) Significantly, both Justice Rajagopala Ayyangar for the majority and Justice Subba Rao in his dissent rely upon the observations of Justice Frankfurter in Wolf v Colorado which specifically advert to privacy. The majority, while relving upon them to invalidate domiciliary visits at night, regards the sanctity of the home as part of ordered liberty. In the context of other provisions of the regulation, the majority declines to recognise a right of privacy as a constitutional protection. Justice Subba Rao recognised a constitutional by protected right to privacy, considering it as an ingredient of personal liberty.
32. इसी क्रम में माननीय उच्चतम न्यायालय द्वारा विनिश्चय Justice K.S. Puttaswamy (Retd.) and Anr. Vs. Union of India and Ors. (2017) 10 SCC 1 में यह मत व्यक्त किया है कि:- "Telephone conversations were construed to be an important ingredient of privacy and the tapping of such conversations was held to infringe Article 21, unless permitted by 'procedure established by law".
33. इसी क्रम में इस न्यायालय की समकक्ष पीठ द्वारा विनिश्चय Shashikant Joshi v/s State of Rajasthan [CRLW 565 OF 2022] Order dated 04/07/2023, में यह अभिनिर्धारित किया है कि:- "When the statute provides procedural safeguards to prevent arbitrary infringement of the rights to privacy, it must be strictly followed. In other words, required mandates could not have been ignored or superceded by the State or its machinery leading to offend the right under Article 19 and 21 of the Constitution of India. If the directions of the Hon'ble Supreme Court in PUCL' case (supra) which has been reinforced and approved by the Hon'ble Apex Court in Puttaswamy's case (supra) as well as mandates of Acts and Rules are allowed to be flouted to affect illegal interception of messages it would lead to breeding contempt and arbitrariness."
34. माननीय मद्रास उच्च न्यायालय द्वारा अपने निर्णय P. Kishore v. The Secretary to the Government and others में यह अभिनिर्धारित किया है कि:- "63. This Court is unable to accept this submission since the boundaries for invasion of a fundamental right through the medium of enacted law is a function of the Legislature and not the Court. Section 5(2) of the Act has set out the Lakshman Rekha and the role of the Court is confined to seeing as to whether the threshold is not crossed. As sentinels on the qui vive, the Courts are gatekeepers of Fundamental Rights. Gate keepers cannot become gate makers to reposition the gates as and when the Executive requires without the intervention of the Legislature as pointed out by H.R.Khanna, J in the case of Godavari Sugar Mills Ltd. Vs. S.B.Kamble (reported in 1975 (1) SCC 696]"........ 64. That apart, the above contention cannot be accepted since this Court is bound by the interpretation put upon Section 5(2) of the Act in paragraph 28 of the decision of the Hon'ble Apex Court in People's Union for Civil Liberties, which has also been approved by the Constitution Bench decision of the Hon'ble Supreme Court in K.S. Puttaswamy (Aadhaar-5J) Vs. Union of India (reported in 2019 (1) SCC 1]. The judgement concluded; CONCLUSIONS: 97. The result of the above discussions can be summed up as follows: "i. The right to privacy is now an integral part of the right to life and personal liberty guaranteed under Article 21 of The Constitution of India. ii. Telephone tapping constitutes a violation of the right to privacy unless justified by a procedure established by law. Section 5(2) of the Act authorizes interception of telephones on the occurrence of a public emergency or in the interests of public safety. Both these contingencies are not secretive conditions or situations. Either of the situations would be apparent to a reasonable person. As laid down in paragraph 28 of the decision of the Hon'ble Apex Court in People's Union for Civil Liberties, it is only when the above two situations exist that the Authority may pass an order directing interception of messages after recording its satisfaction that it is necessary or expedient so to do in the interest of (1) the sovereignty and integrity of India, (2) the security of the State, (3) friendly relations with foreign States, (4) public order or (5) for preventing incitement to the commission of an offence. iii. In the instant case, the impugned order dated 12.8.2011 does not fall either within the rubric of "public emergency" or "in the interests of public safety" as explained by the Hon'ble Supreme Court in the case of People's Union for Civil Liberties. The facts disclose that it was a covert operation/secretive situation for detection of crime, which would not be apparent to any reasonable person. As the law presently stands, a situation of this nature does not fall within the four corners of Section 5(2) of the Act as expounded by the Hon'ble Supreme Court in the case of People's Union for Civil Liberties, which has been approved by the Constitution Bench of the Hon'ble Supreme Court in K.S.Puttaswamy (Aadhaar-5J) Vs. Union of India [reported in 2019 (1) SCC 1]. iv. The respondents have also contravened Rule 419-A(17) of the Rules by failing to place the intercepted material before the Review Committee within the stipulated time to examine as to whether the interception was made in compliance with Section 5(2) of the Act. v. As a consequence of (iii) and (iv) above, the impugned order dated 12.8.2011 must necessarily be set aside as unconstitutional and one without jurisdiction. Besides violating Article 21, it is also ultra vires Section 5(2) of the Act besides being in violation of the mandatory provisions of Rule 419-A of the Rules. vi. It follows that the intercepted conversations collected pursuant to the impugned order dated 12.8.2011 in violation of Section 5(2) of the Act and Rule 419-A(17) of the Rules shall not be used for any purposes whatsoever."
35. उपरोक्त विचारणीय बिन्दु के संबंध में याची/अभियुक्त के विद्वान अभिभाषक का तर्क रहा है कि इस प्रकरण मेंे याची/अभियुक्त के मोबाइल नंबर को अंतावरोध पर लिया गया अर्थात् मोबाइल को टैप किया गया। इसके अतिरिक्त भ्रष्टाचार निरोधक विभाग ने विधिक रूप से जासूसी कर याची/अभियुक्त के फोटोग्राफ और वीडियो बिना उसकी अनुमति के या सक्षम प्राधिकारी के अनुमति के बिना लिए। याची/अभियुक्त के मोबाइल नंबर 9166555111 को टैप करने के लिए महानिदेशक एसीबी, जयपुर ने सचिव (गृह) राजस्थान सरकार जयपुर को दिनांक 14.10.2021 को पत्र लिखा, जिसमें लोक सुरक्षा के लिए उसके मोबाइल की टैपिंग को आवश्यक बताते हुए 60 दिवस के लिए मोबाइल टैपिंग के लिए धारा 5(2) भारतीय टेलीग्राफ अधिनियम, 1985 के तहत अनुमति चाही। याची/अभियुक्त के टेलीफोन टैप करने में क्या लोक सुरक्षा थी, इसका कोई उल्लेख महानिदेशक एसीबी, जयपुर ने सचिव (गृह) को लिखे पत्र दिनांक 14.10.2021 में नहीं किया। महानिदेशक एसीबी, जयपुर ने उक्त पत्र दिनांक 14.10.2025 के साथ जो परफोर्मा ‘ए’ भेजा, उसमें याची को पीसी एक्ट, 1988 के तहत अपराध करने में अंतर्वलित होना बताया, लेकिन याची किस प्रकार अंतर्वलित था, इसका उल्लेख नहीं किया गया है। भारतीय टेलीग्राफ एक्ट 1985 की धारा 5(2) में वर्णित आधार में से कौन सा आधार है, जिसके आधार पर याची/अभियुक्त के टेलीफोन को टैप किया जा सके, इसका उल्लेख नहीं किया गया है। इसके अतिरिक्त विशेष सचिव (गृह) ने याची/अभियुक्त का मोबाइल नंबर 60 दिवस के लिए आदेश दिनांक 14.10.2021 के द्वारा लोक सुरक्षा हेतु टैप करने की अनुमति दी। सचिव (गृह) राजस्थान सरकार ने ऐसी अनुमति देने के लिए विशेष सचिव (गृह) को अधिकृत नहीं कर रखा है। ऐसी स्थिति में प्रथम तो विशेष सचिव (गृह) द्वारा पारित आदेश दिनांक 14.10.2021 विधि-विरुद्ध है। इसके अतिरिक्त उक्त आदेश दिनांक 14.10.2021 में दिए गए 60 दिवस की अवधि समाप्त हो जाने के पश्चात याची/अभियुक्त के मोबाइल को टैप (अन्तावरोध) करने हेतु दिनांक 13.12.2021 तक अभिवृद्धि करने के लिए महानिदेशक एसीबी, जयपुर ने दिनांक 06.12.2021 को सचिव (गृह) राजस्थान को पत्र लिखा। इसके आधार पर सचिव (गृह) राजस्थान सरकार ने दिनांक 06.12.2021 के आदेश के तहत 60 दिवस की अवधि के साथ दिनांक 13.12.2021 तक पूर्व में जारी आदेश के तहत उनमें जारी आदेश दिनांक 14.10.2021 के तहत याची/अभियुक्त के मोबाइल नंबर को टैप करने और मॉनिटरिंग करने की अनुमति दे दी। दिनांक 14.10.2021 को जारी आदेश सक्षम प्राधिकारी द्वारा जारी नहीं किया गया था और वह विधि की दृष्टि से शून्य था, ऐसी स्थिति में सचिव (गृह) की ओर से जारी आदेश दिनांक 06.12.2021 प्रारंभिक रूप से शून्य है। विशेष सचिव (गृह) व सचिव (गृह) राजस्थान सरकार व महानिदेशक एसीबी जयपुर द्वारा याची/अभियुक्त के मोबाइल नंबर को विधि में वर्णित प्रावधानों की पालना किये बिना अंतावरोध पर लिए जाना, एसीबी जयपुर द्वारा उसके फोटोग्राफ्स व वीडियो बनाए जाना भारतीय टेलीग्राफ अधिनियम, 1885 की धारा 5 सपठित भारतीय टेलीग्राफ नियम, 1951 के नियम 419 सपठित भारतीय सूचना प्रोद्योगिकी अधिनियम, 2000 की धारा 69 के तहत विधि विरुद्ध है। इसके अतिरिक्त भारतीय टेलीग्राफ नियम 1951 के नियम 419ए में वर्णित प्रावधानों के तहत ऐसे टेलीफोन टैप से जुड़े मामले 7 दिवस में पुनर्वलोकन समिति के समक्ष रखने होते हैं और उक्त नियम, 1951 के नियम 4, 5, 16, 7 तथा 17 के तहत उक्त कमेटी के द्वारा आदेश जारी किए जा सकते हैं, लेकिन इस प्रकरण में आदेश दिनांक 14.10.2021 व अभिवृद्धि आदेश दिनांक 06.12.2021 को कभी भी पुनर्वलोकन समिति (रिव्यू कमेटी) के समक्ष 7 दिन में नहीं रखा गया। ऐसी स्थिति में उक्त समस्त कार्यवाही आरंभ से शून्य अवैध होने के कारण से अपास्त किए जाने योग्य है। सक्षम प्राधिकारी की विधिवत स्वीकृति के बिना टेलीफोन को टैप करना भारतीय संविधान के अनुच्छेद 21 में प्रदत्त निजता के अधिकार का उल्लंघन है।
36. जैसा कि इस प्रकरण में स्पष्ट है कि एसीबी जयपुर के पुलिस निरीक्षक को यह सूचना मिली कि याची/अभियुक्त धन कुमार नामक व्यक्ति से रिश्वत की राशि बैग में लेकर घर पर गया है। इस सूचना के आधार पर एसीबी जयपुर की ओर से याची/अभियुक्त के निवास स्थान पर तलाशी ली गई। याची/अभियुक्त के कब्जे से कोई रिश्वत की राशि बरामद नहीं हुई। अनुसंधान के दौरान यह तथ्य सामने आया है कि याची/अभियुक्त धन कुमार से मेरियट होटल के बाहर तथा अन्य स्थानों पर मिला। याची/अभियुक्त जिन जिन स्थानों पर गया वहां पर एसीबी के अधिकारियों द्वारा किसी सक्षम प्राधिकारी की अनुमति के बिना उसकी फोटो व वीडियो बनाई गई। महानिदेशक एसीबी जयपुर ने याची/अभियुक्त के मोबाइल नंबर 9166555111 को उसके द्वारा लोक सुरक्षा को प्रभावित करने वाले अपराध को कारित करने के कारण याची/अभियुक्त का मोबाईल फोन टैप करने के लिए सचिव (गृह) राजस्थान से 60 दिवस की अनुमति मांगी। याची/अभियुक्त पीसी एक्ट 1988 के तहत किस प्रकार अपराधिक कृत्यों में लिप्त था और उसके टेलीफोन को अंतावरोध पर नहीं लेने से किस प्रकार लोक सुरक्षा को हानि होगी, इस तथ्य का उल्लेख महानिदेशक एसीबी जयपुर ने सचिव (गृह) राजस्थान सरकार को प्रेषित पत्र दिनांक 14.10.2021 और उसके साथ संलग्न परफोर्मा-ए में उल्लेखित नहीं किया न ही इस तथ्य का उल्लेख विशेष सचिव (गृह) राजस्थान सरकार द्वारा याची/अभियुक्त के मोबाइल को अंतावरोध (टैप) में लिए जाने की 60 दिन की अनुमति के आदेश दिनांक 14.10.2021 में किया गया। इसके पश्चात महानिदेशक एसीबी जयपुर ने सचिव (गृह) राजस्थान सरकार को पुन: याची/अभियुक्त के मोबाइल नंबर को दिनांक 13.12.2021 तक अंतावरोध (टैप) पर लिए जाने की अनुमति सचिव (गृह) राजस्थान सरकार जयपुर से दिनांक 06.12.2021 को मांगी और उसके साथ परफोर्मा-बी संलग्न किया। इस पर भी इस तथ्य का उल्लेख नहीं किया गया है कि किस कारण से उनके द्वारा याची का फोन अंतावरोध पर लिया जा रहा है। सचिव (गृह) राजस्थान सरकार द्वारा दिनांक 13.12.2021 तक याची/अभियुक्त के टेलीफोन की मॉनिटरिंग करने, अंतावरोध (टैप) करने की अनुमति आदेश दिनांक 06.12.2021 के तहत दी गई। भारतीय टेलीग्राफ अधिनियम 1985 की धारा 5 में वर्णित प्रावधान में माननीय उच्चतम न्यायालय और माननीय उच्च न्यायालयों द्वारा विभिन्न विनिश्चय में अभिनिर्धारित सिद्धांत के आधार पर केंद्र सरकार या राज्य सरकार या ऐसा अधिकारी जो विशेष रूप से केन्द्र या राज्य सरकार की तरफ से अधिकृत किया गया हो तो यह संदेह होने पर कि भारत की एकता, संप्रभुता राज्य की सुरक्षा, विदेश राज्यों से मित्र संबंध, किसी अपराध को रोकने, लोक सुरक्षा और लोक आपातकाल की स्थिति होने की स्थिति में किसी स्थिति में ऐसे कारणों को उल्लेखित करते हुए किसी भी व्यक्ति या व्यक्तियों के वर्ग को उसके टेलीफोन टैप करने या संदेश को देने या लेने के संबंध में अंतावरोध पर लिया जा सकता है या निरुद्ध किया जा सकता है, लेकिन इस प्रकरण में ऐसे किसी भी कारणों का उल्लेख महानिदेशक एसीबी जयपुर ने सचिव (गृह) राजस्थान सरकार को प्रेषित पत्र में नहीं किया है, न ही विशेष सचिव (गृह) और सचिव (गृह) ने अपने द्वारा जारी आदेश दिनांक 14.10.2021 व दिनांक 06.12.2021 में किसी कारण का उल्लेख किया है, जिसके तहत याची/अभियुक्त के टेलीफोन को और मैसेज को अंतावरोध (टैप) पर लिए जाने की अनुमति प्रदान की गई। विशेष सचिव (गृह) ऐसी अनुमति देने के लिए सक्षम था इस प्रकार का कोई दस्तावेज अभियोजन पक्ष की ओर से प्रस्तुत नहीं किया गया है। बिना सक्षम प्राधिकारी की अनुमति व अधिकृत किये बिना विशेष सचिव (गृह), राजस्थान सरकार द्वारा याची/अभियुक्त के मोबाइल को अंतावरोध पर लिए जाने का आदेश दिनांक 14.10.2021 विधि अनुकूल नहीं था। ऐसी स्थिति में सचिव (गृह), राजस्थान सरकार द्वारा पारित आदेश दिनांक 06.12.2021 जिसमें पूर्व में जारी आदेश दिनांक 14.10.2021 में वर्णित आधारों पर अनुमति दी गई थी, विधि की दृष्टि से प्रभावी नहीं रहता है, जो प्रारंभिक रूप से शून्य है। याची/अभियुक्त के मोबाइल कॉल को उसके द्वारा रिश्वत लिए जाने के कोई ठोस तथा पुख्ता सबूत नहीं होते हुए और लोक सुरक्षा को खतरा नहीं होते हुए तथा इस संबध में कोई विशेष कारणों का उल्लेख नहीं करते हुए याची/अभियुक्त की टेलीफोन पर हुई वार्तालाप को अंतावरोध पर लिया जाना भारतीय संविधान के अनुच्छेद 21 के तहत निजता के अधिकार का उल्लंघन माना जा सकता है। भारतीय टेलीग्राफ नियम 1951 के नियम 419ए के तहत विशेष सचिव (गृह) और सचिव (गृह) द्वारा दिनांक 14.10.2021 व दिनांक 06.12.2021 को जो टेलीफोन अंतावरोध (टैप) पर लिए जाने की अनुमति दी गई, उक्त अनुमति जारी किए जाने से 7 कार्य दिवसमें पुनर्वलोकन समिति (रिव्यू कमेटी) को भारतीय टेलीग्राफ के नियम 1951 के नियम 419ए के तहत नहीं भेजी गयी और रिव्यू कमेटी के द्वारा भारतीय टेलीग्राफ के नियम 1951 के नियम 419ए के तहत कोई आदेश नहीं दिए गए। ऐसी स्थिति में एसीबी जयपुर द्वारा उक्त विधिक प्रावधानों की पालना किए बिना, सचिव (गृह) द्वारा उक्त विधिक प्रावधानों की पालना किए बिना जो याची/अभियुक्त के टेलीफोन को अंतावरोध में लिए जाने की अनुमति दिनांक 14.10.2021 और दिनांक 06.12.2021 को दी गई तथा पुनरावलोकन (रिव्यू) समिति को नहीं भेजी, भारतीय टेलीग्राफ नियम 1951 के नियम 419ए के तहत विधिवत नहीं होने के कारण से अवैधानिक और असंवैधानिक होने के कारण से अपास्त किए जाने योग्य है। K.S. Puttuswamy (Retd.) and Anr. Vs. Union of India and Ors (2017) 10 SCC 1 व People's Union for Civil Liberties (PUCL) Vs. Union of India & Anr., reported in (1997) 1 SCC 301 में प्रस्तुत विनिश्चयों में अभिनिर्धारित सिद्धांत के आधार पर टेलीफोन वार्ता किसी भी व्यक्ति की निजता का प्रश्न है और ऐसी टेलीफोन वार्ता के टैप को यदि विधि द्वारा स्थापित प्रक्रिया के विरुद्ध टैप/अंतावरोध में लिया जाता है तो संविधान के अनुच्छेद 21 में प्रदत्त मौलिक अधिकार के तहत व्यक्ति की स्वतंत्रता के मूल अधिकार के विरुद्ध माना जाएगा। किसी निजी छवि (Private Image) को उसकी सहमति के बिना कैप्चर करना, प्रकाशित करना या प्रसारित करना धारा 66ई सूचना प्रौद्योगिकी अधिनियम का उल्लंघन माना जा सकता है। बिना सक्षम प्राधिकारी की अनुमति के फोटोग्राफ्स लिए जाना सूचना प्रौद्योगिकी अधिनियम की धारा 66ई के तहत अपराध माना गया है। ऐसी स्थिति में एसीबी द्वारा याची/अभियुक्त की सहमति के बिना और सक्षम प्राधिकारी की अनुमति के बिना याची/अभियुक्त के लिए गए फोटोग्राफ और वीडियो अत्यंत अवैधानिक हैं और याची/अभियुक्त के भारतीय संविधान के अनुच्छेद 21 में प्रदत्त उसके व्यक्तिगत, निजी स्वतंत्रता और निजता के अधिकार का उल्लंघन है।
विचारणीय बिन्दु संख्या-3
क्या याची/अभियुक्त पुलिस थाना एसीबी, जयपुर में उसके विरुद्ध दर्ज प्रथम सूचना रिपोर्ट संख्या 5/2022, उसके आधार पर प्रस्तुत आरोप पत्र दिनांक 04.03.2022 और उसके फलस्वरूप की गई समस्त कार्यवाही धारा 482 दंड प्रक्रिया संहिता के अंतर्गत अपास्त किए जाने योग्य है?
37. इस प्रकरण में याची/अभियुक्त के विरुद्ध प्रथम सूचना रिपोर्ट दर्ज किए जाने से पूर्व बिना सर्च वारंट के उसके घर की तलाशी ली गई है, जिसमें रिश्वत की कोई राशि बरामद नहीं हुई है और जो दस्तावेज मिले हैं, वे भी याची/अभियुक्त को भ्रष्टाचार निरोधक विभाग में दंडनीय अपराध से नहीं जोड़ते हैं। याची/अभियुक्त को प्रथम सूचना रिपोर्ट दर्ज करने से पूर्व ही इस प्रकरण में गिरफ्तार किया गया है। गिरफ्तारी के आधारों और कारणों से याची को अवगत नहीं कराया गया है। यह तथ्य फर्द गिरफ्तारी में अंकित तथ्यों से स्पष्ट होता है जो अरनेश कुमार, सत्येन्द्र कुमार अंतिल व विहान के निर्णयों में माननीय उच्चतम न्यायालय द्वारा अभिनिर्धारित सिद्धांतों के विरुद्ध है। याची/अभियुक्त को गिरफ्तार करके मजिस्ट्रेट के समक्ष प्रस्तुत करने के पश्चात प्रथम सूचना रिपोर्ट दर्ज हुई है। याची/अभियुक्त से की गई टेलीफोन वार्ता या अनुसंधान से ऐसा प्रथम दृष्ट्या तथ्य स्पष्ट नहीं हुआ है जो याची/अभियुक्त को उसके विरुद्ध आरोपित अपराध से किसी प्रकार से जोड़ता हो। इस प्रकरण में भ्रष्टाचार निरोधक विभाग की ओर से सक्षम प्राधिकारी की अनुमति के बिना याची/अभियुक्त के फोटोग्राफ लिए गए व वीडियो बनाए गए जो याची/अभियुक्त के भारतीय संविधान के अनुच्छेद 19 और 21 में प्रदत्त स्वतंत्रता और निजता के अधिकार का उल्लंघन है। याची/अभियुक्त की जो टेलीफोन वॉयस टैप की गई या मैसेज को रिकॉर्ड किया गया है उसकी अनुमति प्राप्त करते व देते समय इस बात का उल्लेख नहीं किया गया है कि याची के द्वारा ऐसे क्या आपराधिक कृत्य कारित किए गए हैं, जो लोक सुरक्षा के लिए खतरा उत्पन्न करते हों। माननीय उच्चतम न्यायालय के विभिन्न विनिश्चयों में अभिनिर्धारित सिद्धांत के आधार पर लोक सुरक्षा, आपात परिस्थितियां जिनमें भारत भारतीय की संप्रभुता, एकता, अखंडता पर हानि आई हो या अन्य कारण जो इंडियन टेलीग्राफ अधिनियम, 1885 की धारा 5 सपठित इंडियन टेलीग्राफ नियम, 1951 के नियम 419 सपठित सूचना प्रौद्योगिकी अधिनियम, 2000 के अंतर्गत धारा 69 में वर्णित किये गये हैं, उनमें अंकित आधारों पर विस्तृत कारण देते हुए टेलीफोन कॉल रिकॉर्ड की जा सकती है और मैेसेज रिकॉर्ड किया जा सकता है, इस प्रकरण में ऐसी स्थिति नहीं है। इस प्रकरण में सर्वप्रथम दिनांक 14.10.2021 को तत्पश्चात आदेश दिनांक 06.12.2021 द्वारा टेलीफोन टैप किए गए। आदेश दिनांक 14.10.2021 को अनुमति विशेष सचिव (गृह) राजस्थान सरकार द्वारा दी गई। इंडियन टेलीग्राफ नियम के नियम 419ए के तहत स्वीकृति हेतु उक्त आदेश दिनांक 14.10.2021 व 06.12.2021 को पुनरावलोकन समिति (रिव्यू कमेटी) को 7 कार्य दिवस में नहीं भेजा गया। विशेष सचिव (गृह) को टैलीफोन टैप करने या मैसेज को रिकॉर्ड करने की अनुमति देने के लिए सक्षम प्राधिकारी द्वारा अधिकृत किया गया हो ऐसा कोई दस्तावेज प्रस्तुत नहीं किया गया है। ऐसी स्थिति में दिनांक 14.10.2021 को विशेष सचिव (गृह) राजस्थान सरकार द्वारा टैलीफोन टैप किए जाने की जो अनुमति दी गई है, वह विधि की दृष्टि से महत्व नहीं रखती है। इसी कारण से तत्पश्चात जो दिनांक 13.12.2021 से याची का फोन टैप करने की अनुमति में 60 दिवस की अभिवृद्धि करते हुए सचिव (गृह) राजस्थान सरकार द्वारा जो अनुमति दी गई है, वो पूर्व में प्रदत्त की गई अनुमति के क्रम में दी गई है। पूर्व में प्रदत्त अनुमति विधि के अनुरूप नहीं है, ऐसी स्थिति में दिनांक 13.12.2021 से प्रदान अनुमति भी विधि की दृष्टि से कोई महत्व नहीं रखती है। माननीय उच्चतम न्यायालय ने विभिन्न विनिश्चयों में यह अभिनिर्धारित किया है कि लोक सुरक्षा व अन्य कारणों को उल्लेखित किए बिना यदि कोई किसी टेलीफोन टैप किए जाते हैं या मैसेज रिकॉर्ड किए जाते हैं तो व्यक्ति की स्वतंत्रता व निजता के अधिकार का उल्लंघन माना जाकर भारतीय संविधान के अनुच्छेद 21 व 22 का उल्लंघन माना जाएगा। इस प्रकरण में दंड प्रक्रिया संहिता की धारा 100(4) के तहत जिस स्थान पर तलाशी ली गई उस स्थान के आसपास के स्थानीय स्वतंत्र व्यक्तियों की उपस्थिति में तलाशी ली जानी होती है लेकिन इस प्रकरण में याची/अभियुकत के निवास स्थान पर जो तलाशी ली गई वो भ्रष्टाचार निरोधक विभाग के अधिकारियों और कर्मचारियों की उपस्थिति में ली गई है। याची/अभियुक्त के निवास स्थान के समीप के स्थानीय स्वतंत्र व्यक्तियों की उपस्थिति में तलाशी नहीं ली गई है।
38. अत: इस प्रकरण में दण्ड प्रक्रिया संहिता की धारा 41, 41ए और 157 (धारा 35 और 47 बी.एन.एस.एस.) सपठित भारतीय संविधान के अनुच्छेद 21 और 22 का उल्लंघन माना जा सकता है।
39. ऐसी स्थिति में उपरोक्त विवेचन के आधार पर याची/अभियुक्त के घर पर ली गई तलाशी तथा याची/अभियुक्त के विरुद्ध दर्ज प्रथम सूचना रिपोर्ट विधि अनुकूल नहीं मानी जा सकती है। अत: याची/अभियुक्त की ओर से प्रस्तुत यह याचिका स्वीकार किया जाना न्यायोचित प्रतीत होता है।
40. परिणामत: याची/अभियुक्त की ओर से प्रस्तुत यह याचिका अंतर्गत धारा 482 दण्ड प्रक्रिया संहिता स्वीकार की जाती है तथा प्रथम सूचना रिपोर्ट संख्या 05/2022 पुलिस थाना प्रधान आरक्षी केन्द्र भ्रष्टाचार निवारण ब्यूरो, जयपुर, उसके आधार पर प्रस्तुत आरोप पत्र संख्या 64/2022 एवं उससे उद्भूत अन्य समस्त कार्यवाही याची/अभियुक्त की हद तक अपास्त (Quash) की जाती है।
41. लंबित प्रार्थना पत्र, यदि कोई हो, भी निस्तारित किये जाते हैं।
